CEL Court case next week

I am defending a claim from 4 years ago and have used this site to research and prepare as much as I can.

After receieving court papers I filled out a basic defence and returned.

I than had a 'last ditch' letter requesting 200gbp to avoid going to court. We have ignored this and I have to appear in court 4/03/15.

I am a little nervous that CEL won't cancel and that I actually have to appear in court.

With dyslexia I am a little overwelmed by the terms you all use to create a deffence. My daughter was 6 weeks old when the court paperwork came and i filled it to the best of my ability between bottles and baby sick!

COuld I have some 'lamens terms' advice on preparing for the court.

    have a read of the NEWBIES sticky thread, it contains what you need for CEL and DEAL

    also look at parking pranksters website

    also check the youtube video a recent court case guy put on there , he won as they didnt turn up (they rarely turn up)

    have your costs ready to get say £90 or more from them out of the judge on the day

    dont accept any late deals to pull out, dont accept any telephone calls saying its been cancelled, always check with the court

    and remember POFA 2012 does not apply, so the RK isnt liable, if you havent revealed the drivers details, dont

    please, please , go do the reading and research asap

  • Also phone the court ( where the hearing is due) ask if they paid the hearing fee. I bet they didn't

    Did you receive their directions Questionaire? Because they don't usually send them to the defendant and they should.

    If not tell the court this also

    According to the pranksters blog they have a bigger problem to DEAL with than turning up to the hundreds of claims they initiated
  • Thank you for the quick response. I filled out the questionnaire . my partner called them so I am the identified driver.

    I slowly reading through the threads to try to get prepared. I will let you know what happens

    They are due in court in Scotland on the 4th. As defendants in a criminal trial. If they don't turn up a warrant for their arrest will be issued.

    check that newbies thread, you can ask the judge for a stay pending the COOP case, the references are there , one for CEL, another for DEAL

    assuming he or she doesnt wish to rule in your favour, also assuming they dont turn up in which case get the claim struck out and claim costs etc

    they could send any old lackey, but I doubt it
  • If you are taking any papers for defence, tie them up in red wool, string or ribbon and only open them in front of the judge.
    Parking firms are notorious for dropping documents on defendants at court and if you have an unsealed evidence bundle you "invite" submissions.
    I do Contracts, all day every day.
  • I meant to say on my post that if the hearing fee has not been paid by them, then the hearing may already be vacated and the claim struck out. (Cancelled in plain English)

    So phone the court in the morning quote the claim number and ask them what the situation is.
