Sorry if this is in the wrong place.
I had a credit card with Lloyds that was defaulted and then settled in July 09, both Equifax and Experian state the debt as settled/satisfied. Lowell then started sending letters about this debt in Sept 09, changing it from Lloyds to Lowell, same amount, same account number.
It is on Equifax and Experian as a debt, but with Lowell Portfolios as the named debt, not Lloyds.
I have spoke to Lowell many times about it, and they say it has to be paid. They are totally ignoring the original settled debt, as if I am lying.
I have now had a county court summons for this Lowell debt and again I have been in touch with Lowell, I have printed credit reports from Equifax and Experian with both debts on, but Lowell are still adamant I have to pay them.
Please help, I am disabled, I get higher rate care and mobility, and have no clue how to fill in the court forms, and cant sit at a CAB for the few appointment it would need to sort this.
Thanks in advance

Turn up to court, tell them in no uncertain terms where they can stick it.I can't add up.0

What proof do you have that you settled it?
Credit file entries are not proof that something was settled by you. Marking the original CRA entry as settled/satisfied is something done also when a debt is sold on.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

What do you mean by the debt was satisfied/settled? Was the debt paid in full or did you reach an agreement with them?

Hi im am considering contacting Watchdog about this rogue firm and would appreciate any support from others with legit claims against them. After many threats and insisting i send a copy of my passport they took me to court and withdrew the day before as i have a zero balance from Orange and they re-wrote it with a later date adding the debt on. I made a counter claim so they had to attend and the judge told their solicitor (who is in house @ Lowell) to remove their debt and conduct their businesses in a professional manner. Unfortunately this was not written in the court report that i can obtain as technically they withdrew so no case to answer.
Lowell still will not remove from my credit file and are not easy to deal with. It would appear that Orange have dodgy staff to sell debts that are not legit.
I also think Lowell have sold my data on but cant prove that.
I had it out with credit expert and paid for months to watch my file.
Credit expert are also wrong to allow any firm to adjust a persons credit and a business themselves which is why they charge...yet our reputation legally lies in their hands.0 -
Lowell, as all DCA's, will try anything in order to turn a profit.
It's not just Lowell that want investigating, it's the industry as a whole, there is very little regulation, although the FSA seem to be cracking down more frequently now on wrong doers, but there are still plenty of shysters out there, you have to know how to deal with them.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. When did you last make a payment to this debt?

Lloyds would have marked the account settled with the CRAs when they sold the debt to Lowell.0 -
Hi, I have read the posts on threats from lowell but they all seem to be from years ago....I am being harassed by them for 2 debts claiming to be 4/5 years old...I have read about the prove it letters that are suggested we write to them, but is this still current for 2016 and if so what proof do they have to provide before they can pursue a court judgement against me? Their letters are very frightening and intimidating and I do not know if the debts are mine or not...
oh also I have made NO contact with them whatsoever they dont have my phone number I am just getting letters from them threatening court...
Thanks in advance0 -

Lowell are usually quite good at stating what the debt was and what the original reference was. If you don't recognise that, then send them a prove-it - they will refer back to the original creditor and usually provide statements.
If they did start a court claim, that legalbeagles link is still current.0 -
