Holiday pay and p45 being withheld

Hi everyone, I am new to this forum so sorry if this has been posted in the wrong place, however I thought this would be the best section for my problem!

I left my job in June 2014 to go travelling, I was on a 12 hour contract and worked my hours over 4 days (normally 24 hours a week) my boss at the time knew my plans to travel and I worked extra hours/shifts such as bank holidays to obtain extra holiday pay, he told me holiday pay was worked out on days worked per week and overall he even told me I had around 18 days holiday up to around when I left?

I came back in December and have been asking them ever since for my p45 and holiday pay and are still not getting anywhere, id did a few shifts over xmas and new year and even had to sign up to a new starter pack, during this time I was asking the boss for my pay and p45 most days, normally he just said he "will sort it out next week" I have emailed the new boss, emailed work/payroll/head office and tried ringing but its always engaged, I have now started a new job and are currently being double taxed! and obviously my holiday pay is much needed as I owe my family a bit of money/paying off xmas gifts.

I was wondering if anyone has any advice or tips on what to do?

    Are you now saying you are working for the same company who wont pay you from June 2014?
  • I left on June 3rd, our next payday wasn't for another two and a half weeks so I presumed it would be on my final pay slip, and I know p45s can take a while to come through, I didn't get back to England until the middle of December, I was working for the same company for five/six shifts over xmas as needed money to get by, and was asking him most days about pay and p45, however I was offered a better job within a few shifts and moved on to that, I have contacted the firm mainly by email and texting my old boss but haven't had a reply.

    So you are looking for the P45 from June 2014 ?

    Do you have a P45 from the Xmas shifts?

    A P45 is done when the payroll is run.

    However an old P45 wont be much use to a new employer as they will just wait for the HMRC to notify of the code you are meant to be on.

    For the pay have you been paid in full for the Xmas shifts?

    I would work out how much you think they owe you from June 2014 and write to HR and request the payment ASAP
  • Did they actually count you as a leaver? No P45 if you weren't processed as a leaver and if you weren't a leaver then you would not have received pay for accrued holiday.

    When does the holiday year end?

    If you were on a 12 hour contract you will only accrue holidays on those 12 hours unless your contract says otherwise
