Pensions on separation /divorce
Timedout
I am retired getting a basic state pension and a couple of occupational pensions from previous employers. My wife is not due to claim state pension for a few years yet nor does she have any other pension of her own to claim. If we separated/divorced how would the pensions be affected /spilt. I heard that the occupational pensions would be split (pension sharing) but not the basic state pension.

If you are in England and Wales her basic split would be half of your work pensions and half of the additional state pension portion of your state pension, that is, half of the part above the basic state pension. She would also by default get half of all of your other financial assets. You would similarly be entitled to half of hers.
There are substantial differences in Scotland and Northern Ireland so you should mention which if either of those applies to you.
I've described the situation on divorce, there are no fixed rules for just separating.0 -

Actually Scottish law would prevail. Do you know how this would differ?0
