Smart Parking Ticket : Parking Charge Notice

Hi,
Today (11/02/2015) my wife received a parking fine in Asda car park in Oldham (Chadderton) from Smart Parking Ltd. She's 36 weeks pregnant and by accident parked in the baby and mother parking spot. She didn't notice the sign as all the parking spots next to it were normal spots.
She did her shopping and was horrified when she got back to the car, a £70 parking charge notice
. She spoke to the security guard who duly informed her that they aren't incharge of issuing the tickets. She however did speak to the guy from Smart Parking who was rude and said he couldn't do anything and said just pay the fine. When she asked for the telephone number, he said they're too busy just write in if she wanted to appeal.
I have read on the forums regarding smart parking and to just ignore them , but what would be the best way to proceed?
I don't want this obviously affecting her credit history etc.
Thanks
Zeddy

"I have read on the forums regarding smart parking and to just ignore them"
are you sure you read that here ?
the 'ignore ' advice changed years ago ....
have a good read

it will answer all you questions including some you have not thought of yet.
While you are doing that go back To Asda and complain to the manager ... not the customer service desk ... the manager.
Show him any receipts you have and inform him that you and your family and friends will not shop there until this harassment stops.
Tell him that all this agrivation is not what you want in your position, and you may need to see your doctor about all the stress!

Send appeal letter headed APPEAL - DEBT DENIED.
Please send your full breakdown of your pre-estimate of loss, also send your full contract with the landowner.!
I expect this claim to be cancelled, otherwise pleas enclose a POPLA verification code so I may appeal.
As DEBT DENIED, No recovery can become involved. charges for such letters will be £22 per letter.
Many thanks
Have a nice day0 -

Thanks Ralph.
You're right, some of the threads were a few years old.
Would it be a good idea and speak to the manager straight away (tomorrow)?
I do think it's appalling (especially my wife being pregnant) the way they treat you. It was a simple mistake, I would have thought they may give a warning, but not a parking charge notice.0 -
do complain to the manager (and/or head office)
if she is covered under the EA 2010 , THREATEN TO SUE THEM AS A COUNTER CLAIM
when the NTK comes , send the template appeal in the NEWBIES sticky thread
that thread tells you everything you need to know
do not read OLD advice, you wouldnt read a 2 year old tv times for tonights tv programmes
read anything in the last 2 years only0 -
Update - we spoke to the store manager yesterday (13/02/2015) who apologised and empathised with us but said he could not overtturn the charge. He said the cark was not entirely owned by Asda as there are other shops on the site.
He did however say if we write into to Smart Parking, he woud be happy to add his bit to support our appeal.
What do you think?
Should I wait for a letter from Smart Parking or should I write a letter before?
Thank you

What do you think?
1) Should I wait for a letter from Smart Parking
2) or should I write a letter before?
Thank you
Zeddy
1) YES, (already mentioned in previous replies) - WAIT FOR THE NTK
cannot stress this one enough , calm down , patience , wait
appeal when the NTK arrives
2) NO - Write it when the NTK arrives , then do both , including complaining to ASDA head office
if you try and rush getting the gun out of your holster, all you will do is shoot yourself in the foot0 -
I did inform you what to do. I have dealt with them more than any other ppc and have one in hand. I have done all my appeals prior to NTK and they have all been cancelled. So the co ice is appeal or pay it0

Firstly no one says ignore. (If in England and Wales)
Secondly read the NEWBIES sticky
Thirdly start your own thread if you have specific questions regarding your circumstances.0 -
Use post 3# and add request for pictures. Smart will not do court and debt collectors are powerless twas. DEBT DENIED0
