    Thanks for all your help and terrific responses. OK, I did not reply in anyway. I did not try to defend myself to the court. So it must have gone through by default.
    I was under the impression that (according to Martin's emergency bank charge article) that if you are struggling financially or on JSA, you still are able to put the claim through to the court. Have I misunderstood?

    Shall I call this guy up and ask him if he can give me a time extension?
    Last time he gave me thirty days. I don't actually know who he operates on behalf of so I think I need to clarify that. But Im not sure that if I contact him i am somehow stitching myself up.#

  • The problem is that the debt collector will have targets to meet just like all other businesses and will want to collect the most money in the shortest time.

    Because you have a CCJ awarded against you they company does not have to accept any offer which is why I have told you to go to court to get N245 and the EX160 so you don't pay the £35 charge.

    I can't see the point in contacting the debt collector - he isn't gonna care. As soon as the company receive notice from the court that you have asked for an amendment to the arrangement they will call the debt back from the collector.

    You can still claim your charges back but you must complete the forms and offer minimum of £5.00 per month. Start paying that and then claim the charges back.

    The debt collector will be very unlikely to accept £5.00 per month which is why you need to get to the county court.

    Bollox to all that . . . just don't let the bailiffs in. There's nothing they can do about it. - they can only break in if they're collecting taxes. Eventually, they'll return the warrant to the creditor who, if they've got any commercial savvy, will realise that it'll cost them more than they're likely to get back from you to keep commissioning bailiffs to hassle you and probably just write off the debt.

    They won't cancel the CCJ obviously - that'll stick around for a good few years yet but you don't sound as though you're gonna be looking for a mortgage or a personal loan any time soon so get yerself a cuppa, put yer feet up and chill.
