Who's responsible for the fence

Hi

When I took my property and sat with the solicitor going through the papers, he told me that the boundary that says T is your responsibility for the fence which is the right side but my neighbour tells me I am responsible for left side as that is how all the houses are and all are responsible for there own left side's
Does anyone know if this T means the fence, Its on my house documents.

  • Someone will be responsible for the boundary, the owner of the fence will be responsible for the fence.

    They may or may not be the same person and there is no requirement to have a fence, however you are responsible to keep such things as dogs under control.

    Thanks for the reply, I remember the solicitor telling me I am responsible for the fence on the right but neighbour says its the left, I did not know that responsibility for the fence and boundary are different.
    Can you please explain how they are different.
  • Because there is no requirement to have a physical boundary.

    Who bought the fence?

    If the previous occupant bought either one you own them.

    Dont know as we bought the property and it was a probate so all we know is from the property documents and from what the solicitor told me, its the first time we will be replacing the fence anyways but just want to make sure I am doing the right one :)

    You could ask your neighbours how they know this? Was this agreed when the houses were new? I don't think its in any legislation regarding where the T is or who has the pretty side of the fence. Not that it's going to help you but ours says in the deeds which fences we are responsible for.

    Boundaries and fences are completely different.

    The Plan attached to the deeds will identify the BOUNDARY you are responsible for. That is not the same as the FENCE. Your deed plan will take precedent over who has responsibility for the boundary, not what a neighbour says.

    The person that erects the fence is the person responsible for maintaining it.
    Eat vegetables and fear no creditors, rather than eat duck and hide.
