Im not some money grabbing in law both worked incredibly hard all there lives and want to enjoy what quality time they have left with each other. My FIL wants to gift money to his sons and wants to protect the rest so MIL will be comfortable if she does have to have care and it not be swallowed up by fees and she be left with nothing.
Isn't this what would happen if your MIL were to need care ? Their hard-earned money being spent on best possible care for either of them.
They have worked hard all their lives and are entitled to use their money to provide the best possible life for themselves.
"Swallowed up by fees" means what exactly ?

I suppose it's similar to tax evasion (not avoidance) with regard to no official time limits as to when they can take action.
How it works in practice seems to be they consider you're guilty unless you can prove your innocence. Again, a bit like tax evasion again
Unlike the seven years rule for gifts regarding inheritance tax, there isn't a time limit on deprivation of capital. Of course, the further back in time the gift was handed over, the harder it is to show that the giver knew they would need care and intended to avoid paying for it.
Unless the giver can show that there was another reason for giving the money, it's assumed it was given away to avoid care home costs.0
