From what I can remember of our meeting is that the "effects" are the property of the O.R and you won't / can't get them back.

Hi savage - the forms SHOULD be the same, yet individual ORs may ask for additional information.
I, too, was asked for the same paperwork as you.
I don't think that we get it back - in fact I'm not even sure if I want it back.
In the case of a 'Tenancy Agreement' I would be surprised if an OR kept it, as it is a legal document that the tenant may need to refer to at any time.
I would, personally, question the need, other than to ascertain details of landlord and rental payments, for the OR to need to see this document, and if the OR needs a record, he can always take a photocopy.
I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

If you want to get housing benefit they will only pay what the cost of council/HA accom costs in your area. For example my house is £685 a month - they only paid £280, this however did alert me to the fact they have social housing in decent areas now. If you get to end of tenancy and cant get another place as credit history poor they have to class you as homeless and you then get put at top of list, theres no other way around it really is there if you cant get a rental agency to take you on. I used to think social housing wasnt 4 the likes of me but then realised actually I was more destitute than many on benefits!0

I think it may have something to do with different types of tenancy agreements. Some have certain stipulations regarding bankruptcy, and I assumed it needed to be checked by the OR. Thus why in my case the landlord was not contacted, as there was no reference to bankruptcy!! I think that you are entitled to ask for it back, savage. It is not a realisable asset and therefore of no value to either the OR or your creditors.

It's worth approaching your LA, but just because you are homeless it doesn't nec mean you will get any help with housing - I'm not trying to scaremonger, just let people know. As a non married, British national, non disabled with no kids and an education behind me, I qualify for no assistance whatsoever despite being homeless for nearly two years now - we have a 'home' now, but it's apparently illegal (depending on which council department you talk to lol) so officially are still homeless. And the council will not do a single thing to help, nor do they have to, as we made ourselves homeless apparently (hmm, its not like we went 'oh being homeless will be fun, lets move out and go do that' but by not continuing to rent somewhere we are voluntarily apparently). It might be the case that petitioning your own BR is therefore classed as leading yourself voluntarily to homelessness and therefore no assistance at all from your LA. I would have thought a large proportion of that depends on where you are though - we live in a very affluent borough of London apparently, so homelessness and being poor aren't usual, plus nearly every member of the council we have dealt with so far has had a serious personality disorder and are seriously unpleasant people in general, so I think this has something to do with it (not just towards us I hasten to add, the stories we have heard on London radio (bbc) about the council here are rather shocking too.)

On the note of paperwork - I don't really have very much due to loosing everything when moving around and being homeless - do you think this is a huge issue?
I have some bank and credit card statements and wouldn't have thought this a massive problem as the OR can get them from the relevant banks etc, but for my rent - I don't actually rent the place, my OH does, and we don't have a tenancy agreement as we never got a copy of it, it's all very dodgy. If the OR writes directly to the landlord we might be in deep deep do do and really literally out on the streets (once more). What do you think might be the best way to proceed on that one? We have a really basic agreement that says the monthly/weekly rent, but nothing like a proper shorthold tenancy agreement. My OH could prove it with his cheque stubs and bank statements if the OR wants, but if the Landlord found out I was going BR to be honest I really think he would chuck us out (we are two months behind on the rent, but have come to an agreement over this through my OH and the agent who is the only person we have dealings with.) If the OR contacted the agent, that would be ok, as he is an ok guy and very reasonable and realises that the landlord has taken us for a ride and we have been really helpful with the council and everything, I'm obviously just a bit worried and didn't even think about this before.

PixiePie - I don't have a tenancy agreement either, I just have piece of paper with how much/when my rebt is to be paid. I don't think your landlord is legally obliged to supply you with one if you only have a shorthold tenancy - there's a useful booklet you can get from CAB, housing benefit offices and it can be downloaded at:
