  • given the length of time the op has had the cards and the fact it seems clear the op had every intention of repaying the debts up to now - i actually think it is quite possible the or (over worked, with massive caseloads and instructions to do the minimum required) wont even pick up on the fact the op lied to get the credit. I would answer every question the or asks you completely honestly - but do not offer answers to questions you have not been asked...

    I was never asked for details of my employment history, nor was i asked about any of my credit applications - the or was only interested in how much i owed and earned at the point i went br.
    I think it is possible you are over thinking this as far as the or is concerned.
    There is a possibility creditors might not even notice as it was 6 years ago but given that you re-paid so much of the money and that they have no hope of financial redress after your br, i can't see why they would bother to chase you.



    hi, but on the forms it requires the last time you worked info, then asks when you obtained credit?
    Your probably right in the fact im over analising but obviousbly need to have all aspects covered.

    On my BR form, where it asked when the debt was incurred - I used approx. years or simply said I couldn't remember - which was entirely truthful. Those dates and my employment history were never once mentioned by the OR during the interview nor afterwards in any correspondence.
    You are insolvent - whatever the answer is to the question you keep asking, it doesn't change the fact you are unable to repay your debts and what else would you do if you don't go BR? I can't imagine living under the weight and worry of debt you can not repay is in anyway preferable to possibility getting sanctioned in some way for fibbing on your application? I do understand how difficult it is but do you actually have any alternatives at this point? :)
  • Thank you, the only other alternative recommeded by stepchange was IVA but i'm assuming I will face the same issue. Plus I would like to go to uni next year i;m hoping that a OR would be more flexable on me being able to obtain a student loan in order for me to better myself, plus if I took IVA and then they agreed to the student loan i;m not sure I could keep up with the agreed payment.
    I'm not concerned about sanctions being put on me i'm concerned it could go down a legal route and get me in big trouble with regards to the fraud.
    Do you think it would be a bad idea to request the original application forms as my sis in law has suggested?
    I really do appreciate your help.

    My own view is, you are making a mountain out of a molehill!

    Get your personal financial ducks in a row, then petition for BR.

    That will give you a fresh start....then, once sorted, go & apply for your student loan next year.

    As GArdener has said, dates need only be approximate....memory isn't expected to be perfect.....

    If a finance company doesn't want to do any 'in-depth' checks [which they probably didn't want to do 6 years ago?]....then that is their problem....there is nothing to be concerned about.

    However, be aware, those of us proffering advice on here, have to cover all eventualities, so it often seems blacker than what it really is.

  • Thank you, sorry if I seem to be going over the same thing and I know I always fear the worst this is because in my life things have not been easy and I always seem to be the unlucky one that suffers the consequences!! lol

    So a deffo no no to asking the creditors for original application?

    ...I think there is a very strong case for letting the proverbial sleeping dog lie here...

    Why go and bring something to the OR and creditors attention that hasn't been asked for? Really - after 6 years leave it. Go with the process with the OR and give them everything they ask for but don't answer this question unless it is asked about.

    The OR has one job only - to realise as much for the creditors as possible - the OR is not there to act as some sort of forensic accountant to go over years and years of your financial history unless they suspect you are hiding assets. Chill! :)
