Can I be forced to carry holidays over to the next year?

Can I be forced to carry holidays over to the next year? The new holiday year starts in April and by then I will have accrued five days but my employer says there is no holiday allowance left until the new holiday year starts. I didn't have the opportunity to book holidays as I am new to the company.

    Most employers have a 'use it or lose it' approach, so it sounds as if they are being helpful.

    Definitely going against the grain here, loo at it as a bonus, you get to book an extra 5 days holiday from april.

    Also you will be able to use those 5 days in better weather rather than use them now.

    If they are part of the statutory 28 days then no you can't be forced to. Any leave above that, then yes, you can. But even in the former case, how far would you be willing to push this?

    You must be allowed the opertunity to take your minimum entitlement within the holiday year, with both yours and your employers agreement you can carry over upto 1.6 wees of your min entitlement. As said above though, you are new, how far do you want to push it?
  • As long as you've had the statutory minimum holidays and these are extras then you cannot force them to give you time off but they dont have to force you to carry them forward, they can simply say you've lost them instead.

    That is clearly mumbo jumbo to cover up bad management and planning.

    If you(or anyone else) had not started then they would have had to manage without you for the days they say they cannot let you have off.

    If they need those days you should have as holiday and/or need you to cover the other days that others are off then they were allready over committed on people having time off.

    A new employee should be added to the workforce with the expectation they will accrue and need to take statutory holidays.

    Now if you want to raise this with the employer is something you should think about quite carefully.

    Indeed.

    In theory, if the OP refused to carry the holiday over the employer would have to allow them to take it. If they were dismissed as a result they could claim unfair dismissal, despite not having worked two years, as it would be for exercising a statutory right.

    However, in the real world.......
