Pre 1998 student loan, ccj, unsure who owns loan
Hello,
I had student loan payments made to me in 1991 and 1992, and I graduated in 1992. The loans were fairly small (I think the combined total was less than £900.)
A house move (rental) has now become necessary, as my current landlord is selling the house in which we currently live. The prospective house requires a declaration of any CCJs - I had one in 1994 or 1995 (cannot remember which, but definitely no later than 1995.) I made a few payments as a result, but then (owing to mental illness) moved from England to Scotland, and never made any more payments. I have never been contacted by anyone with regard to the loan or the CCJ since 1995. I have subsequently moved back to England.
I am aware that CCJs become less visible after six years, but I am also aware that failure to declare would render any contract void. However, I do not know what to do for the best.
My earnings have never met the original repayment threshold of approximately £26ooo per annum. I voluntarily started repaying after graduation in 1992, but ended up missing payments and getting into debt elsewhere as well. When the CCJ was made, I did not attend, but clearly stated on the form that I was not, and had never earned sufficient to meet the threshold. However, the judgement was made against me.
According the research I've made, pre-1998 loans have been taken over by three companies. I do not know which company to contact. Moreover, I have no records of any reference numbers or exact dates to follow.
If I declare the CCJ on the application form for the new rented property, I will need to provide details. I am unsure what to put here, but fear the catch 22 of damned if I do, damned if I don't.
Any advice would be immensely appreciated.
Thank you for your time.

I suggest you post this on the Erudio Students Loans help thread on the credit files/ratings board.
It is a very long thread, detailing the problems many have had with Erudio. Your loans are possibly with them, or could have been split between different companies, but there are some very helpful people on that thread. And I find that looking back at you gives a better view, a better view...0 -

A CCJ from 1995 will not show on your credit file as it will have disappeared from your file after six years whether payments were made towards it or not.
I am aware that CCJs become less visible after six years, but I am also aware that failure to declare would render any contract void. However, I do not know what to do for the best.
I think the contract may well be asking if you have any outstanding CCJs. Please remember that rental companies can only see public information such as current CCJs and bankruptcy. They cannot see historical information not available on your current credit file.

I would advise not contacting any of them. As your debt is so old and you haven't paid anything towards it for well over 6 years by the sounds of things then they have probably written you off. Contacting them may be the worst thing you could do.
If I declare the CCJ on the application form for the new rented property, I will need to provide details. I am unsure what to put here, but fear the catch 22 of damned if I do, damned if I don't.
Do no include it. It is too old to matter.
Any advice would be immensely appreciated.
Thank you for your time.
I would suggest that before you declare anything you get copies of your credit reports from Callcredit (Noddle is free online), Equifax and Experian. The statutory reports are £2 each and Callcredit and Equifax are available instantly online. Noddle uses the information in Callcredit and is free.
You will then be able to put your mind at rest and see what information is currently held about you.
Best of luck. :beer:0 -
Sounds like it's been written off. Even if it hadn't been, the CCJ would be statute barred by this point. Checking your credit files should show which lender has it (if they've even bothered not writing it off by this point).Credit 'Score' - Don't buy the credit 'score' that Experian, Equifax and Noddle want to sell you. It's an arbitrary number that means nothing when it comes to applying for credit.

Thanks for the really prompt replies.
The thread provided by Gardenia was quite horrifying - as well as HUGE. It has inclined me towards not stirring things up!
Solentsusie's reply has set my mind at rest. I have followed the advice to check my credit rating with Noddle (the aforementioned thread states that Experian is in some form of cooperative partnership with Erudio) and there's nothing showing up there.
Given the relatively low amount and the rather large time factor, I'd be surprised if this was still being actively pursued, although the Erudio thread did imply that deferred loans were the ones that had been sold off first. Dunno.
Thanks again.0 -
CCJs don't become less visible, they become completely invisible.
They disappear altogethermake the most of it, we are only here for the weekend.
and we will never, ever return.0 -
If a CCJ is more than six years old from the date of judgement, then the debt itself is still enforceable even if the CCJ drops off from reports produced by Credit Reference Agencies. However, if the creditor wants to enforce the debt after 6 years (by using bailiffs or High Court Enforcement Officers), then they must first obtain a court order.
For the purpose of renting a flat, any credit check that a letting agency or landlord does will only search the public records i.e. CCJs and bankruptcy. As your CCJ is over 6 years old they won't see it and even if by some miracle they found out during your tenancy it would not make your tenancy agreement null and void.0 -
Wow, thanks once again for the replies.
I am certain I'm not the first person to say this, but the people on this forum are utterly helpful and most considerate. Thank you.0
