Rights of a Carer?

Hi
I have lived with my Mother, as her Carer for the past 9yrs. I know that Mums will leaves everything, including the house we both live in, equally to my Brother and Myself. In the event of my Mothers death, can my Brother force me out of my home? I have no assets of my own with which to buy him out. Can he demand I remortgage?

Quite simply, yes to both questions.
As things stand, he is entitled to the 50% share of whatever assets your mother leaves in her will according to the precise wording of the will.
It may be that you have a very good relationship with your brother and are able to reach an agreement with each other; but legally he is entitled to whatever share he is due, however much you personally may have sacrificed over the years to care for your mother.
Your mother could alter her will now (assuming she has the capacity) to protect your position, if she wishes to.
Otherwise, you would be wise to look further into what you might need to do now to ensure your own financial security for the future.0 -
Twiglet0309,
I have answered your question having taken it at face value.
I see you have another thread posted this morning:
https://forums.moneysavingexpert.com/discussion/5158756
in which you state you own the freehold to a property, are not sure whether to rent it to your father, and that you will be the sole beneficiary for your father's estate upon his death; all of which contradicts the dire situation you suggest you might be in as the sole carer to your mother with no assets of your own.
Sounds like you do have assets then....0 -
As stated on thread. Other post was for a friends situation. My mistake for putting it in first person. Only looking for some advice. Seems I chose the wrong forum on the wrong website.0
