Halifax Fraud case

Hi all,
New to the website, so I'm sorry if this is in the wrong place.
I requested a SAR from Halifax for my dad to do PPI claims. After I got the SAR and looked through it, I found all the information I needed for the PPI claim. But I also found that Halifax had send me a forged loan agreement.
There were several [FONT="]differences [FONT="]in[/FONT] the loan agreement to the original agreement. [FONT="]I[/FONT] contacted FOS and they contacted Halifax.
Halifax sent [FONT="]me[/FONT] a letter today about the claim.
Halifax are saying [/FONT]"after completing are investigation we do not agree that a mistake was made" also they say no documents have been doctored. Well since they don't have the original document I would like to know what they compared their documents too...
They have asked for my mum and dad to send any evidence we have to proof the case. I would like some advice on what to say. I've already made copies of the original document and the fake Halifax sent me in the SAR request.
I was thinking of something like....
My Letter:
Dear Sir/Madam
Reference No: 0000000
In reference to your previous letter dated 13/01/2015.We are at a loss as to why you have felt the need to carry out an investigation without first requesting the supporting evidence for the claim.
Therefore we will attach:
· A copy of the original loan agreement. (named “page 1” which you will find at the top of the document)
· A copy of the loan agreement that was sent with the SAR request, which was requested on the 17/11/2014. (named “page 2” which you will find at the top of the document)
Here you will find a list of differences we feel there are in the agreements mentioned above.
· The signatures in the “Signature(s) of customer(s) box” in the loan agreement sent in the SAR request are different from the signatures in the original agreement.
· The date in the “Date(s) of signature(s) box” in the loan agreement sent in the SAR request is different from the date in the original agreement.
· The witness signature, name and address in the loan agreement sent in the SAR request are different from the witness signature, name and address in the original agreement.
· [FONT="]The signed on behalf, by, title and date of signature in the bottom right of the loan agreement sent in the SAR request is filled in. There is nothing filled in on the original agreement. [/FONT]
We would like you to reconsider the outcome of your investigation in light of the supporting evidence enclosed.
We look forward to your prompt response to this letter.

Maybe I've misunderstood, but isn't the obvious explanation:
- Your parents signed, dated, witnessed one form and filed it away but never gave it to the bank (which is why it hasn't been signed 'on behalf of' the bank)...
- Then you parents signed, dated, witnessed the second form which they gave to the bank, and the bank signed (but your parents didn't file a copy)...
Why do you think the bank is 'up to no good'? What benefit would they be trying to achieve?
And what are you trying to achieve though your complaint? In your letter of complaint, you should state what outcome you are looking for.
(Be careful - this is a public forum, and you have named a bank and accused them of a potentially criminal act. They will be able to identify you from the info you give. They may decide to take legal action against you for defamation.)0 -

I thought that at the beginning, but my mum and dad got the form they filled it out and made a copy for records. When there SAR came, they were given a copy that was clearly not written by them. So we was going for compensation for sending us a forged copy of the loan agreement.Hi ftgvukab19

I don't think that's relevant, the fos think we have a case and last time I checked when someone commits fraud, they don't get away with it.

Seeing as the OP was looking into a PPI claim, and then discovered that IN HIS OPINION the lender has sent back false documents, perhaps IN HIS OPINION to negate the original claim then why wouldn't he look for compensation?0

No, it is relevant.
Fraud is defined as an "abuse of position, or false representation, or prejudicing someone's rights for personal gain". If your parents have not suffered a financial loss, and the Halifax have not made any 'personal gain, then there is no fraud.
And from what you've written here, the FOS have not confirmed that you "have a case". You simply contacted them with a complaint, and they forwarded it to the Halifax, for the simple reason that they cannot deal with your complaint until you have exhausted the Halifax's own complaints procedure.0
