debt letter after 6.5 years

hi all,
no one turned up at the door for notice of doorstep collection, but Saturday we received another letter from JES enforcement saying they will now come out to arrange a list of goods they are going to seize if they obtain a court order. they also stated in bold letters, JUST FOR YOUR INFORMATION THE DEBT IS NOT STATUE BARRED.
my wife is going out of her mind with worry, also we looked ate the so called list of payments that she has made and in 2007 they said she paid £1 one week, this I find quite impossible as she paid around £10 a week.
is there anything else we can do?
many thanks0 -
If they turn up tell them to 'sod off' basically. If they cause hassle then you call the police. There is no court order so they cannot do anything, and can certainly not do anything like enter property etc.
So far this company and the one they work for has told nothing but lies.
As said, print letter and hand to anyone who turns up.
As she is worried, please get her to call National Debtline on Freephone 0808 808 400 to talk to one of their advisors. Hopefully they can reassure her.

hi many thanks for the reply, in 2005 me and my partner was on benefits an hyde housing was paying a portion of our rent (private house not council), then we had a letter saying that we wasn't entitled to rent but this was backdated for about 6 and we ended up with this debt for the rent and it went to court for hyde housing, we had no letters saying about this, my partner set up a payment for this from scotcall and a guy collected every week, she just paid him the money he didn't even have a book to put the payments in and we never received any statements from them. one day he said he was leaving and someone else would be collecting , but no one showed for years until this company credit G sent us a letter.
also can they list goods?
many thanks0 -
Hmm.. Are you saying a court order/CCJ was obtained against you/her for the unpaid rent?
If so was that order more than 6 years ago?
This all sounds very tangled, which can be hard to work out via a forum like this, so I would say again that calling National Debtline on 0808 808 4000 and talking it through with a professional debt advisor sounds like the best course of action. Can usually get to the bottom of, and get a handle on things, much better and quicker 1-on-1 on the phone.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

hi my partner done an online check on her and she had no debts owing and no CCJ on her file0

CCJs are removed from credit files and the register of judgements after 6 years, paid or not, so if that old then it may not show, but would still be valid. Technically.
If they have not attempted to enforce any CCJ that might exist in 6 years though, they would need permission from the court which is not very likely to be granted if there is not good reason why they did not try before.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

Hi Ian
Just to reinforce what Fermi has told you this morning:
No court order = NO entering property/NO listing goods/NO seizing anything.
It is up to JES to show that the debt can still be legally enforced, and so far they haven't done that - they've simply made threats. I would advise you not to get into a dialogue with them right now. It is worth your while getting in touch with us, just to cover all the angles.

No - a possession order and a CCJ are two separate things.
It is extremely unlikely that Hyde Housing would have submitted a claim for the money owed at the same time as seeking possession of the property. It would involve a separate process.
I won't be able to check back in on here for a few hours so again, best that your wife calls if she wishes to clarify the position.
