  • Thank you all very much. I was hoping you would say that as I am unlikely to get much more than £10k out of my divorce as my husband has clearly said I wont get any more and now I am 43 and have no savings or pension and 3 children it would really help us start over xxx

    but just be on the look-out for the surreptitious placement of brochures for old peoples' homes?

    Just ensure you keep the bills, receipts, etc...not just for guarantees, but to [eventually] prove to an OR that the 'windfall' was wisely and necessarily spent?

    After all, it s pretty certain that the soon-to-be-Ex will have left you nothing to sit on? Eh? Nod nod wink wink?

    BTW, whilst you are essentially o a low income, so to speak, maybe worth investigating whether you can still get a Divorce using Legal Aid to fund, or part-fund it?

    Might be a useful 'lever' with the Ex?
    No, I don't think all other drivers are idiots......but some are determined to change my mind.......
  • Hmmm, don't assume that the OR won't tell your landlord if they are not a creditor in the BR. Mine told the landlord despite no rent owing, but they are a social housing landlord if this makes any difference?

    OR does not inform landlord of bankruptcy if you have a) an assured shorthold tenancy (which most private rents are, i.e. terms and conditions reviewed and tenancy renewed every 6-12 months) and b) you are not in any arrears with your rent (i.e the landlord is not one of your creditors)


    The OR will ask to see a copy of your rental agreement to check out what you pay but that's only to tally with what you claim on your Income/Expenditure statement and that your rental payments are at the local market value for where you live and is appropriate for your own personal circumstances
