Voluntary Termination Scam
Last October I decided that I could not afford the car I had (job change) and rang the company to see if I could Voluntary Terminate the agreement. I had not quite paid half that I owed so I made a payment over the telephone (£300) to qualify. The car was a Mondeo Titanium X beautiful car and well looked after though quite high mileage not accrued by me. Eventually after me chasing them - I filled in some forms and a guy came to pick up the vehicle. He looked it over and could easily see that it was well looked after and in pristine condition. He took the car away and that was that. That was last October and it is now mid January. Yesterday I got a call from a company stating that they were now in charge of my Barclays Partner Finance account. I stated that I no longer had this account. They stated that I had a £700 balance!!! I rang Barclays Partner Finance and they too stated that there was £700 left to pay. After a lot of to-ing an fro-ing they tried to tell me that the CAP value in its current state did not match what the official guide value was and that I had to pay up!!! I am absolutely livid here. Can anyone point me in the right direction here. About 20 years ago I did a VT and had no problems what so ever. I need advice guys please

Did they give you the £300 figure that you paid on the phone? And confirm at the time that you had repaid half the capital at that point?
Do you have the paperwork from the representative who picked up the vehicle? presumably you have a copy of something signed in relation to the vehicle condition?A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
Also did you take pictures of the car to back you up in regards to the condition it was in when handed it back
£700 seems high for a car in good condition unless it got scratched and dented while it was in their care, but it will be difficult to prove this
why after so long are they chasing you for the outstanding ammount surrly cant take this long to asses any damage/condition

Yes they told me on the phone initially that the £300 was necessary in order to get to the half way mark which would enable a voluntary termination. I also have pictures of the car - it is pristine (was when I returned it anyway)0 -

I dont think that they can. When I completed the paperwork for voluntary termination - there was no statement saying 'if we cannot get the market value' etc. I am under the impression that once you paid your half and return it - providing it is returned in good condition and not in need of repair - there is no comeback. IO have a receipt from the collection company with no detrimental information what so ever. I think they are trying it on0 -
The forms you filled in, were they for Voluntary Termination or Voluntary Surrender?
If they were for Voluntary Surrender, then things like CAP values may come in to play.
With Voluntary Termination, the only condition is the vehicle must be in "good" condition for its age and mileage0 -
I would contact Barclays again and point out that you have had no correspondance from them about the alleged debt and ask them to write to you with full details of the amount they claim is owed and why.
Once you have that and understand why they are claiming money is owed then you'll be better able to dispute the debt.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0
