P45 lost & no p46 sent even after 10 month of new employment

Hi All,
I need some advise. My wife started a new job but no p45 received though former employer said they posted it. She informed the new employer & asked them to send a p46 but new employer haven’t done it for last 10 months. Suddenly we have received her p45 a week ago & handed it over to new employer to deal with HMRC. Now when she inquiry about the latest what new employer says that they lost the p45 & looking for it. There people are totally useless , we are now in trouble as it is continuously deducted 20% tax.
What are the potions we have now? can we directly contact HMRC & tell them the story?

You can print your own P46 and either hand it in at work or send it to them

Photocopy your part of the P45 and hand it to them ........ you did keep part 1A - copy for employee (the one marked "to employee, detach this part 1a and keep it safe") didn't you ?0

Issue is her new employer don't make any effort to send send p46. Can we send it directly to HMRC?0

From what you said your partner should be on a 1000L wk1/mth1 tax code (sometimes shown as 1000LX) until HMRC tell them otherwise. What code are the using?
OT Tax code. She is monthly paid. They are family business so very slow & negative.0 -

So she started working for them in the last tax year (ie the year which ended on 5 April 2014).
Did this new employer provide a P60 in April or May 2014 as required?
Was she not due a refund for the 2013-14 tax year? HMRC should have issued that and I would have expected them to have contacted the employer.
Are you sure the employer is actually sending the tax and NI to HMRC?0 -

She started new job March 2014. No P60 received from new employer for 13/14. We are not sure actually they send tax to HMRC. Tax are done by a family member with help of a book keeper (that's what they say).0
