Hi Guys

Im a complete newbie, sorry if i am in the wrong place!

I received a pcn issued by a bpa member, method was anpr, i wrongly i know now ignored it, and then the next one and now i have received a lbcc.

I have never signed for any of these can i just reply to the original as if i just received it? using the advice/templates on here?

I must have read old threads originally to ignore all.

Can a defence of never having received the paperwork work? as i have never signed for any letters?

my parking mistake was genuine, the signage confusing with some areas offering free parking for 20 mins and some evidently not

What can i do can i start again or say i never received paperwork when summons comes etc

thanks in advance and sorry if i have broken any protocols im very new to this stuff

    2 Not the driver? - Reset the POPLA clock If you are the Registered Keeper, but you were NOT the driver at the time of the 'parking event', you have the opportunity to reset the POPLA clock by identifying the driver. In that case you write to the PPC, acknowledging the LBA, and tell them the driver's name and address.

    See post 13 below for sample letters


    hi i cant find the template to reset the popla clock by admitting being keeper ( wife) but not driver (hubby) - i would love to find this template, sorry for my newbie ignorance :-(

    There isn't a template for that as such - you simply need to write a letter in response to the LBCCC to make that statement. (It would be helpful if you could have a separate address for hubby to receive mail to ... using your own address might muddy the waters with them claiming the driver should be aware of the claim/incident so why wasn't this issue addressed earlier).
    To whom it may concern.
    I am in receipt of your Letter Before County Court Action reference XXXX dated XX. I am the registered keeper of the vehicle with the mark XXXXXXX but I was not the driver on the day to which your claim pertains. The driver that day was:

    Name
    Address

    As I have provided a name and serviceable address for the driver, this fulfils any keeper responsibility and so removes any keeper liability under the Protection of Freedoms Act 2012, Schedule 4. Please contact the driver in respect of this claim. (I believe you are required to send the driver their own Parking Charge Notice, which the driver may appeal).

    Any further contact from yourself or your agents, other than to confirm cancellation of any claim against me, will be treated as harassment and may be pursued through the courts accordingly. Similarly, if you continue to pursue your claim against me I will defend it vigorously, and one of my defence points will be that you are claiming against the wrong party. I shall accordingly seek my full costs in defending your frivolous claim.

    Perhaps wait for others to suggest refinements to the above - don't just send it off verbatim.

    Note: this reset the clock option only applies if there was not a windscreen ticket in the first place and the PPC does not allege that there was. (i.e. if this was a camera-based ticket then you can reset the clock, if it wasn't then you can't). It would also be helpful if you named the PPC - I am assuming it is Parking Eye.
  • Hi Yes its parkingeye, i will use a cross between crabmans template and the above - do you think as its the same address that could be an issue - im the RK but hubby was driving, or is it simply a legal matter that the papers have to be correct - i realsie that the PE peeps may be bogged off i did not supply these details earlier, its been a busy period what with xmas etc - thanks again you are very kind!

    ideally you use a different address, one by a relative or friend or business address

    it can be the same address, but its better to have completely different details , so a drivers name + different address, less hassle and they cannot infer the partner "did know"

    It won't be an issue. PE will reissue a fresh PCN to the driver then the driver appeals as per the NEWBIES thread and wins. End of scam! Forget whether the PE idiots are bogged off, they need to get a real job in Society.

  • Hi there, sorry if I'm in the wrong place! I've recently received a PCN, however it was sent to my previous address as I've moved house and not updated my vehicle log book. (Oops) I popped back to the house to see how they've settled and picked up some post, in the pile of letters there was a PCN, it was from back in December when the supposed offence took place and I've only got one letter saying that the time has passed now and the debt is being passed on and that the debt collectors now can add on there bit as well?! I'm not sure what to do? Help!! The worse thing is I didn't even get out the car or park up, I noticed the sign and drove off!

    start a new thread , copy and paste the above , name the ppc involved, plus a short timeline too , also state the time they say you were there , in and out times , total time etc

    read post #4 of the newbies thread about debt collectors

    read ALL OF IT about the appeals procedures
