Mini credit pay day loan debt collectors

Back in 2012 I took out a payday loan with mini credit, unfortunately due to certain circumstances I had to do a pro rata payment plan with all companies I owed money to. Mini credit wasn't helpful at all, and soon my loan went from an initial loan of 220 to over £1100, any way a debt collectors Mackenzie hall took over the debt and they accepted the amount I had initially sent to mini credit... I've been paying this monthly amount now for 2 and half years... 3 days ago I received a phone call from Osop debt collectors in regards to an out standing debt I have with mini credit, I explained I have been paying an amount to mh, at which point they told me I need to stop paying mh and start paying them. Today I have received an email from this company asking to set up a payment plan or pay the full amount. I didn't realise until 2 months ago I had been given a default on my credit from mini credit and this was at £754, also the £250 I've already paid hasn't even been credited to the default amount, do I change companies or are they just trying it on, also how much do I need to pay, the initial sum that the mh told me or just the defaulted amount, Any advise would be great thanks

Your first step is to write to both companies asking for proof of assignment of the debt. Then you will know which company to pay.

Don't change who you are paying based just on a phone call or an email. You need a written letter with a notice of assignment.

In terms of your credit file. The default amount shown on file won't change. But the current outstanding balance should be updated 'regularly' to reflet payments you are making.

The defaulted balance isn't necessarily the only amount you will need to pay, probably sensible to ask them to send you a statement so you can see how much is still outstanding and ensure all your payments are recorded.

You may also want to ask them to end you a statement so that you can

Although your loan has already been sold to Opos, it might be worth searching minicredit on the FCA website, I'm a new user so can't post the link. There is a voluntary requirement agreed with the FCA that they have ceased offering payday loans.

I had a similar loan with Minicredit, sold on to Opos and I negotiated with them to write off the loan and remove it from my credit file.

    Hi Kimbo80

I can see how this can be confusing for you. OPOS have recently acquired some debts that were originally Minicredit loans, this includes loans that were already with another debt collection company.

If you want confirmation that OPOS now own your debt, then they should be able to send this to you.

Any payments that you made to Mackenzie Hall should be included in the current balance.

If you have any problems with OPOS or you do not believe that the balance that they are chasing you for is correct then we can look into this for you.

You can email us at paydayhelp@financial-ombudsman.org.ukor call us on 0300 123 9 123.

    Kind regards

Check this link out, if you were not sent a deed of assignment by 1st April 2014 saying your debt was transferred to either Kapama or OPOS, from what I can gather, your debt is written off (see page 2).

If your debt had already been transferred to Mackenzie Hall or Fredrickson then it MUST be written off (see from page 6 below)

PS.(I had to put worldwideweb instead of www as I'm a new user!)
