I need help!
I took out a mortgage in 2006 with my now ex partner. We split up around 18 months later and we agreed, at the time, that he would carry on living in the property (he didnt want to leave) and I would move back home and live with my parents. I informed the mortgage company of my new address verbally and in writing, I asked them to duplicate any correspondance they send to my ex partner and to make sure they sent it to me to my new address.
He continued to live in the property and pay off the mortgage with no financial support from me. I checked my credit report in 2009 and seen that he had missed 1 months payment. I queried this with him and he said it was a banking error and that I should ignore it. I asked if he had made any attempt to remove me from the mortgage and he said he had but he had been refused due to various factors. I also contacted the mortgage company regarding the missed payment and asked if he had made any attempt to remove me from the mortgage, they said they couldnt comment. I also queried why I hadnt been informed of the mispayment, and I once again supplied my new address to them.
He then, without my knowledge (I found out a couple of months down the line) decided to rent out the house to a lady, who after 4 months of living there, decided not to bother paying her rent, which then made us default on the mortgage.I was not made aware of any missed payments until there were 5 missed payments in total. The mortgage company had written to my address and asked me to call them urgently.
I called them straight away and advised them that my partner hadnt been living at the address for over a year and that he had been renting it out. The mortgage company also advised me that they havent been able to track him down so I passed on all his contact details (contact numbers & new home address). I reitorated to them how important it was that they communicate with me and send me copies of all correspondance to me at the address I supplied to them back in 2008 and again in 2009.
I then obviously contacted my ex partner to discuss this with him, he wasnt interested and said he wanted the house to be repossessed. I offered to help pay the mortgage and fees (even though I hadnt lived there for almost 6 years)! and save the house but he refused point blank.
Basically, I have just found out that the house was repossessed, and sold suurplus by £23,000, after fees etc paid out that will be a hefty profit he will have made.
I have spoken to the mortgage company and they are currently investigating why I havent recieved correspondance from them. they are contacting me again on monday (12th Jan 2015) to discuss everything that happened and they are also posting out a copy of the whole file for me to look through.
I obviously havent seen a penny of any profit that has been made on the house and I am just wondering what my rights are? Should I have been given half of the profit and how do I go about starting proceedings for this?
This has also left a red mark on my credit file, due to the defaults ont he mortgage. Is there any way this can be removed somehow saying as i hadnt resided in the property since 2008?
Such a mess, any help greatly appreciated. I am now onto the 5th day of a major headache!!!
Thank you in advance.
