The solicitor has informed her previously that he cannot remove her from the house as they have two children and this would not stand in a court of law to eject her from the house.
The solicitor is talking rubbish my OH exes solicitor told him the same, the judge ordered the sale of the house. The children may be a priority but if the finances don't stack up you can't keep a house no one can afford.

Secondly about the finances not stacking up does he have a partner or savings? Just because he can't afford the mortgage from his delared income it doesn't mean he is fiddling. He could be using savings or be being supported by a partner. If his income is what he says if your partner starts rattling the cage she could end up with the house sold, or paying the full mortgage with him paying her about £30 a week.

At the minute based upon his income it looks like he's getting the bum deal not your partner.
