    considering Blackhorse agreed that I could pay a lesser amount and then advised that the government states that cannot put me in a more difficult financial position


    yet they can maybe make me homeless ?
    when I am paying a lot if my loan off and proving to improve my financial situation


    I believe they are acting unfairly :(

    You have checked and Black Horse definitely have a second charge on your house.

    As such they can apply to the court for possession of your house if you do not make your contractual payments and have acted more than fairly by not doing so but (1) accepting lower payments for a fixed period and (2) appointing someone to work with you.

    You mention 'other debts' - these would be a lower priority than your mortgage and secured loan. So credit cards, unsecured loans, catalogues can have £1 per month. You will still need to pay car insurance, council tax, tv licence as these have legal implications if missed. There may be some short term flexibility with utility bills.

    You may wish to post a statement of affairs here and we'll see what's going on in a bit more detail, and check you are getting all the benefits you are entitled to.

    If you cannot pay your mortgage and secured loan, and this looks to be a long term thing, then you may have to consider selling your house yourself and moving into rented accommodation. Doing this yourself is better than allowing the lenders to do it as the proceeds are available to you at the point when you move, and you are likely to get a better sale price.

    and yes i have thought about selling but wanted to wait until market better


    also wanted save my home i have worked all my life
    just trting to pay off debts to get in a better position rearrange another mortgage or find some way to make my life better and keep home

  • spoke to Blackhorse today for the loan taken out I
    april 2008 for £16,000
    loas originally agreed over 10 years


    I have paid £17.258.05 off
    the total amount £30,074.40 inclu interest


    they are deducting some interest to the amount of £778
    and advising Hilsden of this
