And many companies simply say in references that X has been employed by this company for n years. They don't comment directly on the performance of the individual for fear of being sued either by the former employee or the new employer if information in the reference is found to be inaccurate.0 -

Some companies certainly do that.
Many? Well that is debatable.
Most or all? Certainly not.
Yes there is the fear you mention in some quarters, a bit like some of the wild overreactions justified on "health and safety" grounds!
Just how often is there actually a legal claim resulting from alleged inaccurate information in a reference? They are very few and far between.0 -

Do you have any evidence to substantiate the above or are you going by gut feel too? Curious, not challenging.
In my limited experience many references come in the form of a form and very few wanted long pros written but generally tick boxes or 1-5 grades on were they punctual or not, work well or not, what was the method of leaving, job title, dates of employment etc. Surprisingly, I thought, a few asked for final salary.
I personally did fill in most the form, rarely all of it, and never got anything back from them other than a generic thanks and as the people are still employed in those places clearly they arent always expecting to get all the information back that they've asked for.0
