One Weeks Notice

Hi All

Probably a daft question but if I hand my notice in on a Monday morning, and I have to give one weeks notice, does that technically mean I should still work the following Monday?? Or would I finish on the Friday???

I ask because I am almost ready to hand my notice in at my current place of work. I only have to give one week and ideally would have liked to hand my notice in on Friday. This is because after tomorrow I am on annual leave until 5th January, so I was hoping to hand my notice in whilst on leave and then not actually have to return to work at all(my reasons for this are a whole other story!!)

However, it is bank holiday on Friday so obviously no one will be available to acknowledge my notice.

So if I hand it in at 9am on Monday 29th December would that technically mean I should still then be working Monday 5th December?? I am hoping not as that would actually be 6 full working days (so in effect, longer than one week).

    Technically you need to hand it is BEFORE 9:00 AM Monday if you dont want to work the following Monday

    Your other problem is the holidays

    You do realise the whole point of giving NOTICE is to give your employer time (one week in your case) to replace you - how are they going to do that during the holidays?

    Most companies are OK with you if you are OK with them - if you know you are leaving a couple extra days notice is good although again technically once you have given notice they can return the notice

    In my case I had to give 4 weeks notice but because it was Wednesday and i needed to start my new job I asked for the least 2 days as unpaid leave which they didn't even challenge

    Each company is different.

    I handed my notice in on the Saturday, was off for four days until the following Friday and worked for a week. until the Friday.

    It was two weeks notice (ish) I gave. My boss was very good about it.

    Yes I do see what you mean. And to be honest, I would be happy to come back in for a handover one day during my annual leave. That probably sounds like I am contradicting the fact I don't want to come back in on the 5th, but it's a bit complicated.

    I am leaving after only being here a very short space of time due to what can only be described as a huge bully of a boss. This person swears constantly at me, blames me for things that are in no way shape or form my fault (for example, work that was completed before I even started - I get a right shouting at for things he is not happy with), is unbelievably racist, unbelievably sexist, very insulting, extremely demanding (I am ALWAYS the first into the office every morning but if I dare to leave at 5pm - which is the time I am paid until! - I am called a lazy !!!!!) This is not just to me - this is to everyone - I am in no way victimised, I just can't bear working here any longer as it is extremely unpleasant and, to be honest totally inappropriate office behaviour.

    I would be happy (as he is also on annual leave next week) to come in and do a handover with another member of staff, but I can't bear the though of having to work one more day when he is back in as I know I will be given an absolute dogs life.

    If you don't want to work on Monday 5 January, you need to hand in your notice before Monday, 29 December.


    Doesn't matter how early on Monday 29 December you handed in the notice, you would still be due to be their employee on 5 January.

    Thanks for replies, it sounds like should maybe do it 24th December then? Even though I will then have a certain amount of time kind of "unemployed". As I said, if any of my days leave need to be cancelled I will do this to ensure a handover. I just don't want to come back in to the inevitable abuse!

    You do realise that if an employer needs more time to replace someone they need to include longer notice in the contracts they issue.


    Holidays are entitlements that all employees have and may be longer than the statutory notice period, so they should be aware of this and plan accordingly.


    It is not the OP's responsibility to consider the ease with which their employer can arrange a replacement - and in any event they were having to cope with a holiday absence.

    Thanks Littlevoice - I did kind of think it wasn't my issue really as I already have pre-agreed holidays, and it is just purely how it has fell with being offered the new job this week. I don't want to leave anyone in the lurch as I would like to think I can get a good reference, but I certainly won't be waiting until I am back to hand my notice in.

    To be honest (to make myself feel better!!!) it is extremely quiet at the moment so there is very little I can really handover with anyone anyway. All of the work I have submitted is on a central drive that everyone can acess

    I assume your working week is five days Mon-Fri?

    If you work Mondays and you hand it in that day I think most employers would class Friday as your last day.

    If you resign at the end of your shift on 24 December, you could specify your last day of employment as any time on or after 31 December. The notice of one week is a minimum: you can give longer. (You will be aware though that they could respond by giving you one week's notice to finish earlier.)


    You also need to look at whether you will have accrued sufficient leave to take the holiday in early January as paid leave. When does your holiday year end?
