Right to Offset by bank on debt

This is my first post. I suspect that the answers will be grim but here goes. I was unable to pay my Barclaycards and for nearly 7 years have been paying under an arrangement. I was made redundant this week and my redundancy money went into my Barclays account. They have claimed all of it under the Right to Offset ruling. I have a severely disabled son and lost my husband this year. I had planned to use some of the money to help my son with some items or at least a break as he is only 8 and has not really had a break for years. It states that is is covered under Terms and Conditions but I do not have the original Terms and Conditions I signed many years ago.
Is there anything I can do? I dont mind paying some to them but not all my money as I really at this time do not know when I will be able to work again.
Any help gratefully received.

Hi Smellie4Ever and welcome to DFW :hello:

The banks can and do take money from an account to put towards a debt with them, however, I think, they cannot cause hardship - which not being able to feed yourself & pay rent etc would constitute.

One thing they absolutely cannot do is take any benefits you're receiving - the government has given you this money as a neccessity. Somewhere there are template letters, and hopefully someone will be along soon with a link for you.

I would advise getting down to the CAB on Monday morning first thing as they'll be able to help. Also, open an account with a different bank asap to get any future benefits and wages paid into.

You're obviously having a horrible time at the moment so here's a big hug :grouphug: - have you got supportive family & friends around?
