1st Credit

My friend has been with Payplan for a year now and everything is going as planned except for the debts owed to Lloyds TSB (surprise), they sold her card debt onto 1st Credit and a couple of weeks ago they sent her a letter offering a full and final payment option, but as she is paying out the majority of her wages to Payplan there was no way she could pay off a big debt (approx £6500), so she didn't reply to this. This week she has now received a letter from 1st Credit with a load of thinly veiled threats in it, saying they are starting court proceedings, going to garnish? her wages, send in the bailiffs and go after any property that she owns. She is absolutely petrified about this. Has anyone had any dealings with these people? Do they start court proceedings? What can and should she do? To my mind they knew what they were getting into when they purchased her debt from Lloyds and should continue to accept what she is paying every month. Any help or advice would be gratefully received.

Have a look at the OFT Guidelines and identify which ones they are breaking

failing to deal with nominated thrid party - payplan
making unfair demands to full payment
making vague threats of legal action
making inaccurate threats of legal action?
Then write to them and to the OFt and the trading Standards where they are based.If you've have not made a mistake, you've made nothing0 -
1st Credit are up there with 'Mackenzie Hall' RAS.
kpwll: Your friend should contact Payplan again, who have more than enough experience with these cretins. Payplan are busy, but they will have seen all this before.
