Please help, Morgage with ex she won't sell

Moving back is not an option. It would cause big problems. When we split I had a night out and stayed at my sisters. Was late picking up daughter so she dropped her to me. Got her from the back seat (4 months old) ex then started punching me in the head and face whilst she was in my arms. I just took it. Neighbours saw and witnessed in court. She got 5 years suspended sentence. I got threatened by her family if I testified.
Would cause to much trouble.0 -
Could she get it changed to a fixed rate without me agreeing ???0

Mrginge I obvioulsy don't want my child homeless. But I also do need to live somewhere and want my daughter to have her own room and not keep moving so she settled.
Also I'm engaged, we really want to start a family and build a life and family home together.
Not waste on renting, not being able to make it ours, moving often when they want it back (4 times in 2 years now)
Just can't believe there's no way around it, happy to pay 20k to her to be free but no way.
Life is just on hold, by the time it's sorted I'm worried I'll ne to old to get a morgage0 -
Also I tried to get a 2nd morgage as I do earn a lot, but she keeps that one £1000 in arrears. I have paid it a few times so it's up to date to improve my credit.
But then she just misses payments until it's in arrears again.

Is she a suitable parent to your child?
Maybe you should fight for custody of your child, then you would not have the worry of making your child homeless?Every 1% rates go up the morgage increases by £180 a month.
Once they rise she has three options,
1 sell
2 I buy her out
3 hold on as long as she can then repossession.
Wouldn't hold your breathe on the interest rate rising that much that soon, even if it does, you have been paying off the arrears so far...

Then give her the house, its only worth £10k so your share is £5k in equity, just get rid of it and start again.
Assuming she is not cooperating out of spite for a moment, how do you do this and absolve yourself of the liability? a genuine question as I have no idea.
OP, could you not perhaps reduce your maintenance payments to the csa amount and buy/rent a small affordable house somewhere with new partner and apply for custody if accom is appropriate.
Also, you mentioned another child from a previous rel - your daughter is related to, presumably in contact with them on a regular basis. You need to factor her into your plans as well - as that may be causing some resentment to ex and/or abandonment issues for both children too (whatever the age) which can't be helping matters, imo.
Ultimately, servicing the mortgage arrears on a debt you have no control over is folly and there is no incentive for that financial behaviour to change. Look at what you can do or threaten to go to the bank about it. Closure will at least be sooner!

Perhaps one thing you could do immediately at low cost (as it's in your name too), is pay the mortgage payment directly! Documented with a solicitor's letter (c£200) stating that in future the 160/250 will be paid in lieu of maintenance payment for failure to keep a stable roof over their heads. She cannot spend it, your credit starts to improve.???0
