Please help me get rid of a fraudulant debt!

Hi, i am looking for some help with a number of debts that are not mine.

It's a long story but basically in 2007 a number of mail-order catalogues were taken out in my name. These then became defaulted and in 2009 Cabot Financial began hassling me for these accounts. i had contacted them notifying them that I have not opened these accounts and things went quiet. Until recently!
i have now received court hearing letters and have had CCJ's placed in my name. I had contacted the police in 2013/2014 who said there was nothing they could do as at the time i had no evidence to show of these accounts and experian's fraud team had contacted Cabot but could not remove the debt as they say payments were made to the accounts.

I now feel i am completely out of options and will have to pay for something i didn't even know existed!
Could somebody please help me and put me on the right track to finally removing these fraudulent debts from my name?

  • What exactly have you got from the court, does it say it is from the court ?
    You should have had a claim form with the opportunity to file a defence
    I do Contracts, all day every day.
  • I had received a number of claim forms from the "County Court Business Centre" for each of the account in dispute. Experian were notified of these and told me not to reply as they were dealing with the case. After, they then told me to contact Cabot directly. I sent a letter to them stating these were not my debts, however I had no reply from them, only another debt collection letter. But in the last few days i have received a letter from the courts stating i have to pay the debt.

    Whoever at Experian told you that is a ####ing moron. They have lumbered you with a couple of CCJs due to that idiotic advice. Now you will have to apply to have them set aside.

    Yeah, i have come to realise that letting them try to fix this problem has put me in a worse position. What will setting them aside do for me? And how do i apply for this?

    Something you are not telling us here, you dont call a credit agency when you get a court claim form.
    Setting these aside now is going to be virtually impossible, they dont do excuses.
    You were served papers, ignored them and now have CCJ's

    Yes, i had read them and was advised by Experian i did not need to reply as they were in contact with them which will put my case on "stop". Experian also told me to send a letter to notify Cabot this was not my debt (as i had already done previously). i know its far down the line, but with the poor/no advise being given to me I am now trying to see if there is anything i can do.

    I would be tearing Experian off a strip and making them pay to try and get it set aside. Would also contact BBCWatchdog, and others consumer media.

  • Not responding to a court claim means that you will get a ccj in default.

    Debt advice agencies have to have a licence, and insurance, to give advice. I doubt Experian have either, as they are not a debt advice agency.

    They are, however, covered by the FOS. You could ask them if they would look at your case - that doesn't stop you from taking legal action against Experian later.

    You could also ask Cabot if they would oppose a set-aside application.
  • Why on earth were you talking to Experian about receiving documents from the County Court? Since when have Experian been advisors on credit problems?
