    She was obviously in a confused and vulnerable state at the time, and i doubt she fully appreciated what she was signing up to.

    Most people, in a normal state of mind, would tell them to do one, charging £65 quid a month in fees, its just ridiculous, and as good a case of mis-selling as your ever likely to find in my opinion.

    Complain first to the company in writing, if no joy after final response, or 8 weeks, escalate it to the FOS.
    You would need to be able to demonstrate that you were either :

    (A) Not made sufficiently aware of the cost involved,

    and/or,

    (B) You were in a vulnerable state of mind at the time, and could not reasonably be expected to comprehend what you were signing up to.

    couldn’t be done by myself anyway. Or indeed by free services such as payplan or
    stepchange,


    You have no more sway with creditors
    than myself talking to them directly and providing them with income/expenditure
    etc as they are duty bound to accommodate those in hardship despite you alluding
    that you had “great relationships” with various creditors so you would be able
    to negotiate better with them




    still waiting for a final response have had a few interim apology letters asking for more time but willing to give them time to respond as ive a lot of other things on my plate at the minute, but a refund of fees wasnt something id contemplated, interesting....

    You've done exactly the right thing, if they were making unsubstantiated claims, such as the one you quoted, that's is reason enough.
    If you get nowhere, go to the FOS, and ask for interest on top, you would be entitled to 8%, as a court would award.

    I hope no-one has been caught out by this. Heard in the past that companies have lost DMPers funds.
    Debt -it's a fight that I'm winning, dealing with debt one day at a time.

  • Could your daughter ask for a Subject Access Request for the data they hold on her? That way she can find out who they have been paying. Whilst she's at it I would due asking for an up to date statement of payments made and balances still owed.

    A "S.A.R" costs £10 quid though, she has no need to pay anything to find out who her creditors are, as they will all be writing to her very shortly, i would assume.

  • Yes, no need for a SAR. I would suggest getting a copy of her credit report though as that should clarify a lot very easily. http://www.moneysavingexpert.com/loans/check-free-credit-report
