left work and now being accused of theft

Appologies if in wrong place this is my first thread.
I started a new job after working in care...the job was cleaning the job was not great so gave my notice in and left was there 3 weeks.
Employer said she would send my pay....never heard anything so kept asking for pay and nothing no wage slip p45 crb sent back so i told employer i was taking this further with acas etc.....
This was dec 1st....
So dec 3rd to police officers stand on my door and the employer as accused me of theft from a house we visited which is totally untrue she claims it was me as i was upstairs but the other cleaner went upstairs to check my work even though she didnt do this in any other house we visited.....the other cleaner hasnt been interviewed as it was me apparently...the police asked if my finger prints would be in the house well thats obvious as i was cleaning.....she wont give me wage slip still not paid me i actually think she doesnt give wage slips, and i think the company is not honest regarding tax ni etc and she once told me dont tell tax credits you work as i know a lady here who gets full tax credits and works lots of hours....
I deleted my texts stupidlly as didnt expect this.going to get a sim reader as may be able to access deleted texts so i have heard...i resigned she telling the lady whos been robbed she sacked me....
Should i continue with my claim against her for wages or wait as i know i have upto 3 mths to claim or should i carry on dont want to make my theft alligation worse.....hoping if i stop the claim for now they may back down as she good friends with all her clients......plz any advice appreciated

  • Forgot to say the day the lady reported it to the police was 11 days after the alleged incident the same day i told my ex employer i was taking things further with acas......the lady i worked with knew i only had a mop in my hand when i left she had a bucket and large morrisons bag with cloths cleaning stuff etc in and a jacket but she hasnt been interviewed because she is best frienda with the boss.....very peed off with this....
  • If , and we have no reason to doubt it, your version of events is accurate then the police will not, or should not, charge you or even caution you, as they will likely not be able to prove beyond reasonable doubt that you are guilty of the so called theft.

    Back to your unpaid wages .... yes you have a claim. Proceed. First you have to go through ACAS to seek conciliation .... i.e. hopefully identify a solution without escalating matter to an employment tribunal.

    If ACAS cannot help you then you'd have at least one to three more months in which to file a claim to tribunal for unlawful deduction of wages. If you are a low earner and have low savings then you may well get a waiver off the £250 filing fee via a a scheme called a EX 160. Even then the filing fee is recoverable from ur ex-employer if you win.

    I am in and out of Tribunals each week so I and other members should be able to assist. Alternatively, try Citizens Advice Bureau, some centres may be able to help.

  • Thanks...i didnt steal anything and as i said have someone who was wiyh me but she wont say anything against the friend thats her boss..
    .i have been released on bail so am worried i have a solicitor in place if i need them.....will putting a claim in for wages make it worse...should i also report the company as i am sure they are hiding things thats why they refusing wage slips and p45 and if you google them theres no actual business address only phone numbers...some of the staff are not crb checked i was...so many odd things i now notice
  • The employer is clearly trying to scare you off. I would stand up for justice. You should report all you know to the police and/or tell your solictor, assuming the latter is any good at their job, or is even a solictor ..many duty staff at stations are mere paralegals.
  • Thanks but i wander if i hold off for a few weeks from starting proceedings for getting my wages back if they will see sense and stop this accusation..
    I have spoke to acas about wages.....
    i am just so worried if i claim my wages it will make things worse...i am a mum of 3 and didnt do anything i cant go to jail....
    i have upto 3 mths to go to courts regarding wages or would a court see it that i held.off due to accusations.....so confused

    Based on what you say the police will not take things further. If you report your concerns to the police re your former employer they may even charge the employer for wasting police time. Yes, you can wait to raise a claim, but don't wait because you are scared. If you are innocent, you are innocent.
