OK so you're self employed.
Why are you asking him for a breakdown, I assume for tax, when it's YOUR responsibility? It's not his responsibility to do your accounts for you which is basically what you appear to be expecting.
So you're NOT entitled to wage slips and NOT entitled to a contract. Also if he doesn't pay you or doesn't pay you properly, you've got no recourse other than that which you'd have if you were running a business and a customer didn't pay, i.e you have to go chase the money, usually ending up in it going through County Court and you never seeing it.
You CAN'T get ACAS to help because you're not an employee.
You're NOT entitled to any protection an employee has and can't pursue it through an employment tribuneral because you're not an employee and you're not employed.
Sorry but you're now paying the price for "playing" at being self employed and not doing it properly. As a self employed person it is entirely up to you to keep accounts of money paid and owed, to pay tax and NI due, to chase money owed. It's not his responsibility at all to keep these details for you.
If you want a wage slip, contract of employment, holiday pay and someone sorting out your tax and NI, get a job as PAYE.0 -
have you read what I have posted above? this is how abta want homeworking travel agents to be employed, I was only asking for help and
can't understand why you need to have ago.
as for asking for a wage slip how else can I do my tax return?
I can't invoice him for the money I make since if I do a holiday booking
for £xxx and I make 60% from that
but before he can pay me he has to wait for the invoice from the operator
the vat etc has to be taken off.
I also pay £70 a month for line rental
I don't get comm on vat cc charges adsl tod
so they is no possible way any homeworking travel agent can do they own
wages you get a rough idea but thats it.
this is the way its done with thomson airtours first choice future travel holiday experts hays travel and all the others.0 -
I'm pointing out the actual facts of the situation you're in, what you're not doing and what you should be doing. If you think that's having a go, well, that's up to you but I'm merely pointing out the facts.
You know what you make for bookings, ex VAT, so you invoice him weekly or monthly for that total.
The fact that he has to wait for the money from the operator IS NOT YOUR PROBLEM. His VAT IS NOT YOUR PROBLEM.
A homeworking travel agent CAN do their own wages. You know what the commission is. You therefore know what you've earned and what to invoice for.
The worst part is, because you've not a clue how to be self employed properly, I suspect you're also paying more tax than you need to as you're not allowing for the expenses you occur such as ADSL subs, stationary, percentage use of your home - all which can be classed as an expense which therefore reduces your profit and therefore the tax bill. And if the taxman decides to do an audit, you've no books to show him so he could come up with any figure he wants and you've nothing to support it.
Seriously, you need to get yourself off to your local Business Link and do a course on self employment. It's free and it'll give you the help you need to do it properly and save money.0 -
sorry but you don't know what comm you are making I have been self employed for eight years and never had any problems . I have books that go back for eight years I did have an accountant once but since my neighbour
is a self employed accountant she now sorts things out giving them the once over to make sure I have done them correctly.
the operator sends a invoice the parent company take 10% he takes 30%
and I get 60% that is after the none comm bits have been taken out.
this is even down to any comm we make on cc charges so without the
manager report run I could not work my comm out I can do it to a fashion and have a rough idea but we get inc for selling say virgin and I have been waiting for mine since jan, again the parent company take 10% of them
trust me I have my head screwed on when it comes to figures but this is
impossible to get your head around with the formula0 -

So if you don't know what commission you're getting, how do you know if what you're being told is right?
If you're self employed, why do you think you should have a contract from him? At best, you can hope to get a table of rates.
Also is the person doing your accounts making sure you're claiming for expenses you incur or are they simply making sure you've totalled everything up right?
No wonder the travel industry is pushing this type of working. The poor sap doing the selling gets screwed from all sides and is highly reliant on the franchisee providing the figures being honest.
Personally, I'd not touch this way of working with a 50ft bargepole. I'd say if you were happy, stick with it, but you're not.
Seems the strangest way of being self employed I've seen.0 -

So you got something via email. What does it say about how your earnings will be calculated and when you will be paid?
yes will copy a bit in
60% of commissions earned paid on the VAT date on the 16th of every month.
-commissions payable 42 days in advance of the passenger travelling
-deductions may be made for overpayment and or errors costing the company money.
-if you leave the company commissions will be paid after your last passenger departs.
-pay advice will be sent prior to pay day.

Wow! Doesn't make much sense, I agree.
By their writing "if you leave the company", it looks though you could claim to be employed (though I know you don't want to do that).
It's terms of business that I think you should get from "the guy". If you are self-employed it is those which are the contract terms you are working to. As the version you seem to have been provided with are so poor (possibly badly over-writing another set of T&Cs). As an initial step, I think you could try contacting the head office of XXX travel and find out their terms of business.0 -
hi
this is the problem with head office
he is employed by them well sort of he uses they abta bonding and I am employed by him so its a catch 22 I am going to try and get to see
cab today my wages turned up yesterday two weeks late and cost me
£120 returned dd was expecting about £1800 got £7000 -
TBH, it's the guy you're working for rather than the parent company that you need to be directing your efforts towards. It's worth contacting the parent company to see if they can lean on him but in all honesty, they're not obliged to.
Got a funny feeling CAB is going to say there's not much you can do as you're self employed but I hope I'm wrong.
I've got a funny feeling this is heading for Small Claims Court.0
