I have received my notice after my appeal but need some more help please.

I received the notice rejecting my claim, however the notice was written on the 5thof November and posted 2nd class on the 28th of November. I received it this morning 01/12/14. This is 59 days after I appealed, they stated in an email the following:-
Please supply these details within the next 14 days so that they can be passed to the appeals team, with your appeal, who will be looking into your appeal for you and they will respond within 35 days of receipt of
the original appeal, during this time all charges will be frozen.
My question is before I start trying to unravel their long letter, could I win based on the notice been sent out of time? There are many other mitigating circumstances but hoped this would be an easier way out of it!

    1. Check the POPLA code in post #3 of the Newbies thread 'POPLA code checker'. See when it expires (will be today or earlier I reckon), never mind, do points 2 and 3 anyway.

    2. Lodge the fact you want to appeal on POPLA's appeal page today, assuming you have a POPLA code. Put in the box that the full appeal will follow, will be based on the fact there was no GPEOL and no initial loss, and no standing and other points about signage. But Armtrac have only posted the POPLA code to you 2nd class on 28th November so this is the subject of a complaint to the BPA and you require and expect to be allowed, an extended 28 days to follow up this brief appeal so that you can add your full POPLA appeal before a decision is made.

    3. Email Steve Clark and Gemma Ridgewell as you saw on Raybelline's thread:

    Demand that this complaint is investigated as Armtrac are doing this to more than one person, leaving them with no time to use a POPLA code which is hardly an example of a professional parking firm 'driving up standards', indeed it is sharp practice in the extreme, borderline fraudulent denial of your right to an ADR. Attach a copy of the letter and the envelope and ask Gemma how long you have as 'extended POPLA appeal' time.

    Armtrac keep doing this - we've seen at least 2 cases, if not more.

    I have had exactly the same thing. They said they would reply within 35 days and it took 57 days. IMO this would be case closed but I assume that they have different ideas...

    It's not how long they take to reply, it's the fact they are sending out of date POPLA codes to people.
