We stupidly have a secured loan with Moorgate and when I lost my job got into arrears.
My main Mortgage company were great (Coventry) and that one is sorted.
Since I started work, I have been paying the arrears off slowly but surely at around £40 on top of the standard payment. Last month I paid £70 over the normal payment.
As far as I am aware the amount left in arrears is less than £300. I sent a letter to Moorgate stating that contact is only by letter, yet they constantly called me about 3 times a day (on home/mobile and work number), which I did not answer.
They have now sent an 'agent' out from Excel for the remaining arrears and he is now constantly calling to get in touch with him. He called round today while I was away on business and saw my OH, told her that I should contact him and that if I don't it may mean the bailiffs may get involved.
I am sure he is not allowed to do this and if the arrears are only £300 do you not think they are being heavy handed?
My OH half has told me to call him tomorrow to arrange a meeting, but I do not want to meet him as according to their website their only interest is the company they are working for - They appear to be a posh named debt collection company...
I want to get back on top of the arrears but a figure I am comfortable with and not one they make up..

Send Moorgate a written complaint about sending the guy round.
State in writing only.
Tell them you will escalate to the FOS if they refuse to deal with your reasonable request
and continue to ring/call in person.
If the guy shows up, tell him to go away as you only deal in writing.:beer:0 -
I am hoping that if the balance is correct for the arrears - I will not be in a position to clear if off in 2 months. I know the guy wants to see all my outgoings and income - but there is no way he is seeing my payslips or bank statements - as far as I am aware only the courts can demand to see these..
By the way I am not hiding away some savings, I just do not want them looking at my private documents.If the world is a stage... I want better lighting!0 -

The lender will have had the opportunity to demand payslips, bank statements etc. at the time of your initial loan application. This "agent" has no such powers and appears to be exaggerating his authority in order to put you under pressure.
There is no role for bailiffs to play in this scenario - at least, not unless things somehow progressed all the way to an eviction. That is not going to materialise over £300 of arrears which you are already paying off.
You should check whether this use of an "agent" has resulted in any sort of administrative fees being added to your account. If so, you may wish to challenge these by arguing that you have already been paying off the arrears without any such intervention being required.

He is just a debt collector wanting his percentage, he has no rights at all to see anything.
Ignore the chap completely, you do not have to deal with him.
If he calls again, film him on your mobile, they don't like that.
Search utube for similar clips, write to the DCA as Happy bunny has advised.

I am sure they have added about £85 for the visits..
I have always paid over the amount owed - but they always wanted me to pay more than I could afford to pay comfortably.

Do consider a complaint and subsequent escalation to the FOS in that case. Obviously no two cases are the same, but the Ombudsman has in the past publicised complaints it has upheld about "unfair" arrears charges on mortgages and secured loans.

I have just had a text from him and he has confirmed the outstanding arrears are approx £292 - I can clear this in 3 months easy - I do not know if that includes his charges though.If the world is a stage... I want better lighting!0
