Joint Mortgage & Ex has left Country

Please help I am after some advice

I jointly own a home with my ex husband (not deviorsed) I had to leave the home and he remained with the promise to pay me out which never happened.

The agreement was that he would pay the mortgage as I had to pay to rent accommodation, I change my address etc with my bank but I went to get money out of my current account (which is with the same bank as the mortgage) one sat morning and it swallowed my card even though I had been paid the day before.

It turns out he hadn't been paying the mortgage for the last 6 months and the bank for some reason had been sending the letters to that address not mine like i had requested so knew nothing about it till I rang them about my current account which they had frozen.

It also turns out that my ex no longer lived at the address, had let it out with out my permission and was spending the rent money to live instead of working.

I Paid the arrears to stop the house being repossessed on the agreement that I brought the house off him and all the rent etc was signed over to me for me to pay the mortgage.

So I paid the arrears and £2000 Stupidly i know and he gave me a letter that said he was happy for the mortgage to be in my name.

But before I could put everything into place he left the country is now in America somewhere and none of his family (who i'm quite close to) haven't heard off him in 2 years.

I rang the bank and told them it was let but without his signature they can only make a note of it and not agree to it.

I'm now stuck paying for all repairs and the difference between the mortgage and the rent every month and I'm told that without his signature I can't do anything, can't sell it, can't officially let it can't do nothing and its really getting me down, I just want to close this chapter in my life.

To add to it now there are debt collectors calling at the house because he owes money everywhere (think he had speeding fines before he went away his mother has told me) and he owes £22000 grand to the CSA for the 3 children he has from a relationship before me.

I really don't know what to do I know most of it is my doing but I can't put it right.

Any advice is welcome.

    Go to the Citizens Advice Bureau before this gets any worse.

  • I have they said there is nothing I can do without his signature but I don't see how that is right does that mean that I'll always be stuck in this situation if he never returns?

  • Permission to sell can be granted by the court - in the same way as a sale can be forced by one party to joint ownership (but part of the equity released may fall to the other party). Solicitor time rather than Citizens Advice or forums.
