If you get repossessed they will give you either no notice or very little.
The Council will not re home you either as they will class this as deliberately making yourself homeless.
Sueing him is all well & good however if he is that skint what are you sueing him for?
You cannot successfully sue someone if they have no money as you'll get nothing even if its been awarded by a court.Unless specifically stated all posts by me are my own considered opinion.

Be guided by your solicitor. At least by paying the mortgage yourself you maintain a home for your family. You cannot force your ex to pay the mortgage. Though you can pursue for maintenance through the courts and obtain an attachment of earnings.0

If you can afford the mortgage pay it to keep a roof over your head whilst you negotiate everything else with your ex through your solicitor.Changing the world, one sarcastic comment at a time.0
