Hi guys, first time poster long time lurker.
I have a loan that was defaulted a long time ago for around £200-odd or so which is now standing at £1030. The original loan was with Speed-e-loans.
They first contacted my earlier in the year during tough financial times with the usual scare-mongering letter threatening this that and the other, however this time, the letter has bold red writing and says
"Should you fail to reply within 10 days of this notice then formal COURT action can be taken for the unpaid debt and we will submit a claim (form N1) at the county court business centre-northhampton"
love how they made COURT capital haha.
But yeah, slightly concerned with this letter and i absolutely refuse to pay that amount for a debt originally so small.
Will they actually take this further, and if so, how can i defend against the ridiculous charges?

How long ago was the default?
Speed-e-loans went into administration (what a shame!) in July last year. As a result SSL may have problems getting hold of your original paperwork,
I suggest that you send SSL a CCA request, there is a template letter here. https://forums.moneysavingexpert.com/discussion/7096390 -
I did know that yeah, it was fantastic news when they went into admin haha.
i made the foolish decision of calling them (made sure my number was hidden) and i disputed the amount and they basically said that its not their problem and they've been sold the debt at that amount so the full amount would need to be cleared. I even went to the extent of asking them when they intend to take action and their answer was vague at best.
I am also right in saying that i only need to pay the original net amount (275) plus 60days interest?
They were incredibly rude on the phone with absolutely no courtesy or even as if they was interested in what i had to say.
I am definitely going to send a cca request as i have a sneaky feeling they might not have a copy of my CCA.
what's your opinion on this anyway? Do you reckon they will take me to court over this? I still live at home and i don't own a car or any real assets to be honest.0 -
The loan was taken in 2012, with the default occurring shortly after.0

I doubt they did buy the debt for the full amount. They probably spent a few pence in the pound and are trying their luck with everyone.
Who knows whether they would take you to court, some companies do and some don't.
Worry about that when you come to it. In the meantime get CCA'ing them.
