Debt Help Advice

Can any one give me some advice.
I ran up debts on my credit card in 2005 when I moved to a new house. I also took out a loan. I moved jobs then I lost my new job and had to fight for a few months to my wages. I had no money to live off of never mind pay my debts and I knew I would be losing my house soon (It was a private let) Also at the same time my partner fell prgnant. My G/F was on the sick at the time and we claimed on the insurance for our loan with citifinance. It took ages to claim as there insurer lost our fourms a few times. We then got a letter telling us the claim was successful and never again heard from citifinance. A month ago we got a letter from Hillesden Securities wanting the full amount paid. I called them and told them about the insurance claim and that I had worked out that I only owed two months the advised me to contact Citifinance. So I called them and they told me because of how long it took for there insurer to proccess my cliam they cancelld it so I now owe them the full amount. I called Hillesden Securities and told them I would be contesting this. The girl on the phone told me that it was ok as I would of been given a refund for the money I paid for the insurance. I told her so many times that money refunded was £20 but the insurance was ment to pay five months of money around £600. Finaly she got the messege and told me " Were just going to take you to court then as you dont have a leg to stand on"
I have been seriously ill for the last year and due to mistakes with benifits we recive a reduced rate to live off of each wek for two adults and a baby. I cant afford to live from one day to another never mind make any payments. I also have three credit card debts with Capitol 1, MBNA, and Halifax. I was getting letters and phone calls from Thames credit on behalf of MBNA for a while asking for the debt to be payed, each time I would tell them of my predicument then all of a sudden they stopped contacting me. I was getting letters from a company that I cant remember the name of on behalf of Halifax telling me it was my last chance of paying the debt in full (I got about six of these all saying the same thing for a few months) Then I got a letter from a lawyer telling me I had one more chance and the debt had been passed to him. A few weeks later I got a letter from the previous company giving me one more chance. A week or so later I got a letter from halifax offering to reduce my debt if I started paying them. Capitol one have never contact me and my credit report they have my old address even although all the other companys have the right one.
Can anyone tell me what is going on and what could happen to me. I have tryed debt managment companys but the want more than I can afford so they wont take me on. Any help is appreciated

    Hi, sorry can't help too much.

    When you say you have tried Debt companies - have you tried the charities CCCS and Payplan as they don't charge any fees for the DMP. They may still be able to give you advice even if they can't take you on for a DMP.

    Do you have any proof of the insurance claim at all? Sending this with a complaint may help. I understood if you disputed the amount of a debt then they cannot collect on it, but not entirely sure. I think you should write to them so you have proof you dispute it and state that the terms of the insurance should have covered that much of it.

    Hi, sorry to hear about your situation. Do contact CCCS. They are a charity. They will help you for free, and not take any money for setting anything up.

    I went through their website last weekend and they gave me a new budget, and several different options for dealing with my debt. I didn't even have to talk to anyone, it was all done online. You need to have details of all your income and outgoings handy and some details about your debts - like how much you owe to who. They didn't think I had enough money to be on a debt management plan either, so they have recommended a Trust Deed - which is the Scottish form of an IVA - sort of like bankrupsy. I'm just going through the process of setting it up now. It is very scary! But I am relieved to have things sorted out, and I feel that CCCS have given me a very good and realistic budget to live on.

    I manage my own DMP you can start that up today all you need to do is download all the information from the National Debthelpline they have template letters, payment calculators it really is quite easy.

    First rule is make sure your bank account is not connected to anyone you owe money too so may need to apply for a bank account.

    Second thing I did when I knew I had an account (I applied to Cahoot - I like online! later I got an A&L account a year into all my problems!!) is write to your debtors and tell them you are having difficulty ask to freeze interest (again template letters for this)

    A month after that I send out payment offers with cheques, most of my companies only get a little over a pound and they did freeze interest and accept payments.

    I changed my phone number too so that all my companies have to deal with me by letter, that way I open my mail and sort things out when I feel ready.

    Sounds a bit whimpy but thats debt management for you I manage it now!
