Barclaycard AP instead of Default

Hi

I am in a DMP and owe Barclaycard £200 now.
I have been on a DMP since 2009.

I called Barclaycard this evening as the account was showing as AP instead of a default like the rest of my accounts. They initially advised it was on default but called back in 10mins to advise they had intended to but never did. As a gesture of goodwill they have written off £50 so I now owe £150.

Should I accept this or complain to get the account defaulted.

    the account will stay on your credit file for 6 years from the default date - which would be next year

    if it is not defaulted then it will be 6 years from your final payment - which will be 2020

    which would you prefer?

    Sir/Madam,

    LETTER OF COMPLAINT

    I refer to the above mentioned Barclaycard Account which is being reported on my credit reference files.

    You have been reporting arrangement to pay markers (APM / AR) on the above accounts since (date of first AP marker) - over 5 years , which places me in a disadvantage compared to a debtor who has had an account defaulted .and therefore will continue to appear on my credit file until 2020 It would appear that you have used arrangement to pay markers in place of a default on the account, It is understood that the Information Commissioner's Office does not agree with this and states that this is Unfair practice.

    The definition of a default
    9 A ‘default’ can be said to occur as soon as a borrower fails to meet the terms of their credit arrangement.

    An ‘arrangement to pay’
    21 This involves a temporary, short-term (up to six months) arrangement where the lender agrees to accept reduced payments

    I believe therefore it is against Information Commissioner's Office guide lines for this debts not to have been defaulted on or before (insert date when you think it should have defaulted).

    I ask therefore that you place a default date of (date you think it should have defaulted) with all 3 credit agencies for the above account. This will bring it in line with my other debts that was all defaulted at same time on entering my DMP

    These AP/AR markers are likely to cause considerable problems to me financially as the account should have been defaulted in 2009 and the default removed in 2015, this data will be displayed nearly 5 years longer than necessary.

    I will continue to pay payments on these accounts until fully paid

    I look forward to receiving a prompt and proper reply.

    I think I have spent more one on postage this week than anything else.

    Can I ask what happened with you?

    Barclaycard have already credited the £50 they offered last night. So they have reduced my balance to just £150.00 but I'd much rather have the default.

  • I 'defaulted' and entered a DMP in 2010 but they didn't default me. They just kept putting on AP markers. I complained, I think in 2013 and they agreed to add a default date of 2010. By then the debt had been sold to Cabot who failed to reflect this and added another default in 2013. After many letters I have finally got Cabot to put the default date to 2010 on their records.

    My defaults start falling off in 18 months and will all be gone by the end of 2016 and I hope I can then stop being a leper.

    A default is worse than an AP marker. Your credit history, i.e. dmp marker, will still be visible for 6 years anyway. I'm in a dmp and have AP markers from Barclaycard, but would rather keep an AP than a default. Mortgage providers for example will look more favourably on someone with an AP than a Default. With an AP it shows you are making an effort to repay.
