Falsified Payments

Hello,

I was hoping to get some advice about a debt that I believe is statute barred. I am clear on the last time I made payments to that account and it is over 8 years now. However the Agency pursuing the debt has sent me 'proof' that i was making regular payments. Some of these payments overlap a period when I was aboard, so was physically not here to make the payments over the counter.

I know the payments are falsified, They are on plain paper so could have been tampered with. How can I prove that to the court? I have a hearing coming up to dispute their claim.

I am 100% certain that I made no such payments. I disputed them long before these claims of a regular plan.

  • if it is on plain paper how does it show? does it show how it was paid? the account it was paid from?

    remember that statute barred can also include written acknowledgement so if you were disputing this did you do that accidentally?
    The only people I have to answer to are my beautiful babies aged 8 and 5

    Probably best to get onto legalbeagles where there are several people challenging such falsified payment claims or schedules.

  • The payments they show are on plain paper. I know I made no such payments as I was abroad for half of them. They show as being paid by BGC.

    The payments may have been made but at least 3 years prior, so it seems if they have changed the dates because I know I never made those payments.

    Also I remember when I was making the payments years earlier, they had frozen the interest and charges, this shows that it had not stopped.
  • If you have proof you were abroad, something like Passport stamps, receipts for tickets, etc, then this would be a good defence if the case came to court.

    Plus courts do not take kindly to evidence on 'plain paper'.
