    They can send a copy that they have reconstructed, as long as they are accurate. Only reason they normally do this is cos they don't have the original.

    Hang on a minute, the agreement was dated 2004, so although a recon agreement may be satisfactory for the purpose of the sec 78 request, it may not stand up in court, should it get to that stage.
    They would have to convince a judge, that on balance, the original agreement, if it no longer exists, did so at some point.


    I had a similar account that I CCA`d, and got the same response, I argued that as they didn't hold the original, they would not be able to obtain a CCJ against me in court, and, they agreed as much, and closed the account, and wrote off the debt.
    Mind you this was with Lowell at the time, not the OC.
