Hello I hope this in in the right place. I am at the final stages of a divorce and have been issued a consent order which requests I place a charge on my marital property. I would like to know if I can do this myself without having to pay a solicitor the £500 or so to do this for me... I understand I have to contact the land registry however the website is a jargon filled mine field which I cannot get my head around...Can anyone help?...

Is it mortgaged?
Who is the title registered to (assuming it has registered title)?
If mortgaged, you will have to employ a solicitor (or at least pay for one) and the mortgage company will need to be prepared to allow a second charge to be registered, afaik.0 -
Reedfish - I am sorry that you find our web site confusing. You can apply for a charge on the property and it will depend on whether there is any restrictions that you will need to consider. Have you obtained a copy of the registered title? If not you can do so by using the Find a Property service for a fee of £3.00.

As TrickyDick101 has mentioned, if a charge is already registered you may need their consent and they may insist that you use a solicitor. If not, you will be able to apply yourself. Please have a read of the online guidance through the link supplied for further information on the registering of charges.
