Refund of postage after online return

I recent purchased an item from Office through their web site. As I knew there would be a chance that I might want to return the items I checked their return policy to see if I would have to pay the return postage, as I know this is not a legal requirement of the distance selling regulation.

Their website states the following:

"WHERE DO I STAND WITH DISTANCE SELLING REGULATIONS?
If you notify within 7 working days, by email or letter, of receiving your item of your intent to cancel, we will be happy to refund your postage costs. If notification is received after 7 working days, we will only be able to refund the postage should an item be incorrect, faulty or received damaged"

I read this and thought it meant that they would refund my return postage, now having purchased the item and decided I want to return it I have phoned them up to see how I get my postage refund and they have told me that they only refund the postage to me and not the return postage. I feel that their website is very ambiguous and as I bought the item with the believe I could return free of charge then they should refund that money too. Do I have a leg to stand on?

  • I'm pretty sure if you change your mind through no fault of the items you bought, the return postage is down to you to pay for (but legally they have to refund any postage you paid when you undertook the original transaction).

    After all, it's not their fault you changed your mind, why should they lose out on the return postage cost.

    Different if you have a faulty product though.
    Saving for a return trip to America, 3 weeks on Route 66 for our honeymoon just wasn't long enough!
  • I agree that if their web site said nothing about returns policy then you would be correct.

    But their web site states that they will refund postage costs if I tell them within 7 days, and with that knowledge I purchased the goods expecting to incur no costs if they were not suitable.

    I am now out of pocket as they are failing to honour this condition of sale.
  • I actually phoned up my credit card company that I used to purchase the item from and they have agreed to pay the postage costs :)
