Moorcroft-is this allowed?

I am dealing with all my debts, and on a payment plan which I set up myself. The only people I have had problems with have been Barclaycard.

I have continued to communicate with them by letter, despite their ignorance, and they have had all my income/outgoings etc. I have paid them monthly, initially £1 token, but now has increased, as my income increased.

They no longer send me statements. I had communication from Credit Solutions, and sent them my SOA, and they agreed to my payment plan, but never sent me any forms for standing order, so I continued to pay Barclaycard, as I had been doing.

Now I get communications from Moorcroft.. I sent them my SOA last week, however, today, I get a letter Notice Of Intended Litigation, and all the costs etc. This doesn't really scare me, as I know that I have been paying what I can to barclaycard, and there is no way I could increase it.

What concerns me, is that they have stated on the bottom of the letter "Please note we have confirmed with a major public utility that you are in occupancy at the above address."

I have never denied this, but just wondered whether they are legally able to do this? I am just about to contact them, and want all my facts.

    I would have thought that goes against data protection you should give national debt helpline a ring, I do my own debt plan but they will still give you telephone support.

    If it does break data protection put a formal complaint in writing and also complain that they have never sent the promised details.
  • It may be a standard 'scarer' sentance that they put on all letters.

    Or they may have looked at the electoral roll

    Thanks for that. I didn't think they were able to do it, but just wondered before I ask them which national utility they managed to get the info from!

    I am sure it will all be okay once the teething problems have been sorted, but will keep the NDL in mind.

    They are good, I mainly use the website and look at there template letters I also downloaded there payment calculator to make my offers look more formal. But once Lloyds sent a letter that worried me at the time can't remember what they called it and I rang and they basically reasurred me it was nonsence.

    Then I got mad and wrote and made a formal complaint to Lloyds and got my own way and a refund!

    Its nice to have your confidence boosted occasionally!

    Nothing scary of course they know where you live how else would they send you letters. Standard DCA threats it's all a bit sad how desperate they are becoming.

    thanks all. It makes me laugh when they think they are scaring people. I suppose unfortunately, their tactics do scare some people!!! Fortunately we have this wonderful place to come to!!!

    I have just received a letter from Captal One to say I have defaulted on my agreement to pay £1 a month, so can I send them £2 straight away. So I just phoned them, and explained that I have been paying £48.55 instead, as I had sent them a new SOA in April.

    So........they can't accept the new arrangement, because it is in a different name......doh, the last one must have been too, as they are now stating that they have never received my change of name details TWO YEARS AGO! So they accepted the first paymant plan, but not the higher one, yet they were both sent in my married name????? I am paying £48.55, instead of £1, so I am now behind on my payments?

    They would like a copy of my marriage certificate before they can accept payments from me (although they are being credited to my account) even though they would have had this 2 yrs ago.

    I wish some companies were more efficient! Some have been fantastic, and some just a total bunch of morons!

    Oh well, they will have to wait for the info, as I am due to have a baby any day now, and this should be the last thing I should have to be worrying about!!!

    Well, I am going to email Moorcroft now, because if I speak to themI will probably blow my top, and I need to try and stay calm!
