You didn't mention in the OP that you had been off sick. It could well just be a breakdown in communication between your old boss and HR. One thinking medical certificates are required and the other telling you they aren't.
  • Hi all

I've heard back from HR today and my old boss has completely lied saying I refused to work my notice. I have been working for the company for almost 5 years and feel absolutely disgusted by the way I am being made out to be a liar.

I assume if HR believe her over me i m screwed? I can understand the company are protecting there revenue but its just wrong.

When you handed in your notice that presumably contained your leaving date as you were giving notice. So if you have kept a copy of that, it's proof you were intending to hand in your notice.

If you were offered garden leave (which is the wrong thing if you were ill) then that should have been mentioned in your exit interview - was it noted down, do you recall?

You can go to your doctor and request a sick note but you will have to pay for a private one if you need it backdated. If you explain to doc that you were off sick and need to now send a note to cover you from that period to present (or end of notice) then they should do that.

Personally if it were me I would be in touch with the union. A bit of well worded correspondence from them would sort this.
