Help with teachers pro rata pay

    Hi Yes I do and because I have experience in payroll and pro rata pay outside of schools and we did not treat our staff in the way she has been treated so I have a little more understanding than my wife and she would rather me deal with it for her as she has found it all quite upsetting.

    Every single worker gets paid holidays. That's a basic right. An employer has the right to choose when those holidays can be taken. So all workers in a school get paid holidays they just occur during the school breaks whether they are a cleaner or head teacher.

    Obviously pro rata is a minefield and it has changed a little from when I last dealt with it years ago but it looks like it'll be going to tribunal although the 3 month window has passed so we will see how it goes.

    Small claims might be better
    Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked

    As she's not on national terms and conditions it will depend entirely on her contract what she's entitled to.

    When I have worked term time contracts my pay accrues over 39 weeks plus holidays but is effectively disbursed over 12 equal monthly payments. Therefore adjustments may be required depending on when contracts finish.

    paid holiday is right, how much holiday would a full timer get and how many weeks would they work.

    statutory holidays is 5.6 weeks so 46.4 working minimum prorata for 39 weeks is 39/46.4= 84%

    well yes I see where you are coming from since they technically can't work all 52 weeks of the year being as school is 39 weeks only. However, teachers would get the full rate (what i refer to as the 52 week rate) as for some reason they get paid the full whack.
    Support staff are ALWAYS paid pro rata which is the 39/52 week rate and are further penalised if they also do pro rata of 37 hours per week.
    I'm just quoting what happens to me and how payroll explained why I got so little in my pay packet.
    I know it's wrong but it's what happens to support staff in schools all over the country, unless they've negotiated better pay & conditions.

    WHEN I quit, which will be very soon, I have to give one months notice and I am expected to work my notice (although for some reason it says I can be obliged to take 'garden leave') so I will get paid for my notice unless I quit with immediate effect and not work my notice in which case I will only be paid for the days I worked.
