claiming travel allowance

hope this is in the right place
my husband has recently joined an agency, he is a lorry driver and they find him work, eg Bloggs transport want a driver for a few weeks, the agency rings my husband and offers him the job, when it comes to an end they find him another job elsewhere. [hopefully]
they say if he signs up to the travel scheme they claim back tax and NI on his petrol receipts for travel to work in his car. he gets the NI and I assume they get the tax.
Can he claim this himself rather than using an agency to do this for him please?

    I'd advise your husband to be very wary. The situation sounds similar to this:

    HMRC sees this as an abuse of the tax law and is clamping down on this wherever possible. Reed Employment lost a tax case based on this in 2012 and had to fork out £158 million as a result.

    HMRC will usually go after the employer in these instances, but make sure your husband checks that he's not signing something to make him liable if it goes tits up. Personally I would avoid this, as it is not in the spirit of the law and HMRC will refuse the claim if it is not water tight.
