Doorstep field agent visits

Hi, a family member that lives with us has had a handwritten note addressed to them pushed though the door while we were out saying it is to 'establish contact' between him and the bank. There is a long-standing dispute between them and the bank.

This is merely a question about our rights and their rights.

The letter says the agent will be calling again today or tomorrow. How do we prevent this? They are in contact with the bank and do not want this aggressive debt collection while the dispute is investigated (obviously).

    Just tell them to get lost as the matter is in dispute and you are already talking to the bank. That is they come back you will treat it as harassment and call the police.

  • I've told the field agent and the company she works for that they have no permission to enter our drive and if they attempt to do so, I'd call the police. She got a bit shirty but obviously knew she had no leg to stand on.

    No.

    But if you wanted to, you could write to them withdrawing their implied right of access and reiterating that the 'debt' is in dispute and any further unwarranted attempts to contact you will be viewed as criminal harassment that will not be tolerated.

    I think you've said it yourself - this field agent has no special legal authority or powers. More to the point, the bank may potentially be falling foul of the FCA rules on collection of disputed debts:

    Worth referring to this if they persist with the use of this agent.

    OP, a "field agent" is a fancy name for a debt collector, nothing more, nothing less, its a job for someone eh !!
    There job title does not empower them with any "special powers or rights", they are not, for instance, bailiffs.
    They can knock on your door, you don't have to answer, you can tell them to leave, and if they don't, you can call the police.
    They don't have any right of entry to your home, no matter what they may say.
    Best way to get rid of them, if they should call, is to film them on a mobile while you answer the door, and ask them to leave, from the video's I've seen on utube, that usually gets rid of them !!!
