I applied for deferment of student loans repayment in May this year. When I applied for deferment I was a full-time student and as far as I understand, was fully eligible for deferment. I started a full-time job in september which takes me above the threshold and I expected that I would start paying back my student loan, but noticed Erudio had already started taking money from my account as far back as July, so I called them up. The adviser told me that my original application failed because they did't recieve evidence (which I sent). He told me he would put my account on hold and advised me to resend my evidence. At this point I told him that I had started a job in september which takes my above the threshold. He said it, doesn't matter because Erudio will treat the application from the date I originally applied, and therefor will allow deferment for another year. I sent the evidence and called them again a couple of weeks later only to be told that as I am above the threshold now, they won't defer. I explained that they had taken money from my account two months prior to me being employed and asked them to at least refund those payments to which the advisor said no, its too late now as more than three months had past since the original application.

Can anyone advise me where I stand legally in regards to getting a refund for the period that I was not employed?

    My sister became terminally in June and passed away in July so I wasn't really keeping an eye on my account

    When they started to take money from me I was not in employment but was in full-time study. Consequently, I had to borrow some money from family because I had run out of money a week or so before my first pay-cheque. Erudio's response was "tough luck".
