Mobile company 3 using a debt recovery company called C.A.R.S to chase money from me

About 14 months ago I bought a temporary wireless thing to use when I moved into my new home whilst my proper broadband supply got sorted out. It was with the mobile company 3 and it was a monthly rolling contract so I could cancel with one months notice at anytime. I only planned to use it for the first month until my proper broadband went live and I did really only use it for a month and then I put the thing a way and never used it again. After I continued to pay each month for about 6 months after me not using it anymore, I decided to cancel my Direct Debit as I had problems calling 3 and waiting so damn long for them to answer. Since then I have been continually harrassed by phone calls and letters by 3 and more recently a company called C.A.R.S recovery services telling me I owe them £32. I have just been ignoring the letters and phone calls but I am worried as the last letter says that this is my final warning and if I don't pay then I they will take me to court. Do you think this is likely? On another matter I do want to say that I think I have been harrassed as 3 were calling me at least 10 times a day leaving automated messages and now this C.A.R.S have been calling me same amount of times and they have called from landline and mobile numbers and I have checked each one online and it is them. Many thanks.

They are unlikely to take you to court for such a small amount, but they definitely can. What should be more of a worry to you is that they will likely mark the default in your credit file, which will make credit harder to obtain for the next six years, and also increase the likely charges.

Is that a sensible thing to risk, just in order to avoid paying a debt that you know you owe?

    Hi Nick,

You're cutting off your nose to spite your face here...

You can't end a contract (even if it is a 30 day rolling contract, you still need to follow the notice process or you're liable) and while it is a pain to get through just grin and bear it! It's £32 which is nothing in the grand scheme of things and I think you'll be able to avoid getting a default (horribly damaging to your credit file) by coming to an amicable solution and playing ball.

As for being harassed, you could have ended it a long time ago by just paying the £32 and washing your hands - you're taking it too personally by the sound of it, easily done but ultimately daft :)

Agree with Monkeyballs on this, but to be honest, for such a small amount of money, they will not pursue it for long, no chance of court either, if you value your credit file, give "3" a ring, and pay up.

  • Does 3 have a shop near you? If you can't reach them on the phone, you could always go in and cancel it. Monkeyballs and the others are right, it's really a very small amount to wreck your credit rating over if you can afford to do otherwise.
